Yes, you can file online through various websites who will put the paperwork together for you. I would recommend going this route if it is uncontested.

Get on the website for the court where you would file and look around for pre-printed court forms. Print out two sets one for you one for her. Read them think about them talk about them ask questions. Look at your public library or bookstore for books about it in your state. If you really are working together you can hire a transactional lawyer to help you navigate The process. This lawyer can’t take sides of course so it only works if you’re really not fighting but that is that best approach when your cooperating

I want to thank all those who gave their experience and advice last year. Here's what I did:

We hired a paralegal who guided us through which forms needed to be filled out, and helped us fill them out. The paralegal drafted the settlement agreement in legalese. I had my wife hire a lawyer to look it over to protect her interests (and protect me from future problems).

Then the paralegal rewrote the settlement agreement, submitted everything to the court; and we are now divorced. Finalized. Fully divorced. We never had to physically go to the court house.

Assuming you are England or Wales...

...it is quite possible.

Divorce is just a paperwork exercise. It is usually done without a hearing - just sending the right document off. Pro-tip. Make sure you get exact names, addresses, etc. on the document - the court will send them back if there are any discrepancies.

As things are amicable and assuming you don't want to hang around you are going to have to use unreasonable behaviour as grounds. Basically one of you needs to demonstrate the court why you can't reasonably expect to put up with the other's behaviour (i.e. the marriage has broken down irretrievably).

This is the sticky point. Talk to your wife. Make sure you both understand that one of you is going to have to say the other one has done not nice things (although no one other than you, her and the court will ever see it unless one of your waves paperwork in front of other people).

As you agree on financials you don't have to do anything, but you do remain tied to her financially until you get a clean break order or there is remarriage. Most online divorce places don't mention as far as I can tell - I suspect they'll get you to pay for an online divorce and then offer you a chance to draft a consent order too.

Yes. It’s possible however the advice given to me was a situation like this have one lawyer draft it and another review it to prevent the worst case scenario where one party comes back in two years and says they didn’t have the appropriate legal advice to knowingly sign the contract.

No kids, relatively simple finances and assets? Sure. But, if you have real estate or brokerage account then it gets iffy. If you can just agree "I keep my retirement account and you keep yours, we sell the house and divide equity 50/50" then totally doable. I've known a few people make a clean and amicable break like that.

Or, hire a neutral mediator for a few hundred bucks to draft up the details and file for you. That might be a better way unless you both work at Burger King, no kids, and are broke with nothing to divide.

Of course you don't need lawyers, in fact that's preferable to everyone including the courts. You can just have a paralegal draft it up if you agree on everything, you'll be done in a couple days

If its uncontested for sure then by all means go for it if you trust her enough. Atleast consult with a lawyer just for a backup plan if things go south.

I used arizonaonlinedivorce.com, but I think they have one site by state just change Arizona by California. I did all the process and even went to the court to deliver the paperwork, no kids and so, it was easy on the paperwork at least. I did all of the paperwork.

Yes, totally possible. If there are any significant or complicated assets to divide (like retirement funds), then you'll need a special court order for that which you'll really want to have a lawyer do. If there's an alimony obligation either way, better to have a lawyer review the overall agreement. Also, if you're filing joint taxes now, there will be some implications in moving to filing separately so it's good to talk to a tax advisor to see if there's some efficiencies to be gained based upon a certain way of dividing assets or managing the impact of alimony.

Alot of states have legal aid clinics that can direct you (at minimal cost) on simple, non-contested divorce.
