Another thing you can do to support the husband is carefully write down what you heard Maria tell your wife. Then go to a notary public and swear out an affadavit (sp?) affirming what you heard to be true, and make sure it is dated today. BEFORE anything happens. If it ever comes up that the husband is falsely accused of violence against Maria, your affadavit can be submitted as evidence of her intention to defraud the government before the fact.

As a battered spouse, child or parent, you may file an immigrant visa petition under the Violence against Women Act (VAWA). VAWA allows certain spouses, children and parents of U.S. citizens and permanent residents (green card holders) to file a petition for themselves without the abuser's knowledge. This will allow you to seek both safety and independence from the abuser.

It sounds like the VAWA free green card pass does not apply when both parties are undocumented.

You have a good opportunity to support men's rights here. Let this poor chump know what his wife is planning before she puts him in jail. It's just a matter of time before she discovers that he doesn't actually have to hit her - she just has to say he did.

My wife teaches english as a second language (ESL) at the library. One of her female students sometimes baby-sits my 18 month old (lets call her Maria). This morning, Maria tells my wife that she went to a wedding with her husband (lets call him Marcos), and was dancing with every man she could ... to make her husband jealous. Maria then talked about an attractive divorce option ... if she can get him to hit her.

Is this true? They are BOTH undocumented. I know that an undocumented wife of a US citizen can cash in a VAWA automatic green card ... but how about when both husband and wife are undocumented?

Background: Marcos worked as a landscaper in the US since 1985, sending money home to his family in Mexico. Wife+kids came over from Mexico in 2002 because Bush policies made it very difficult for Marcos to visit his family during the winter (when he is unemployed). Feminist thinking appears to be seeping into Maria's head, and now she wants her "fair" share of the feminist divorce lottery.

I agree with what CMOS222, said. Don't make it dramatic, just handle it legally and within the limits of the law. Please keep us up to date, I'm hoping that you can help this person not have a horrible experience.

You definitely should tell him what your wife said, the problem is this is ultimately just a he said she said and he is likely not going to believe you. I know you don't want to hurt you friend but you might want to try to get some evidence to present him with.
