This is not a new issue in family law in NZ, Australia and other countries. Income and property related to "special skills" or "special attributes" have been the subject of propoerty disputes in many jurisdictions before. What's new here is that a female is being treated without privilege, and forced to share their property with their ex-partners, like men have been forced to do for many years.

I find it difficult to believe there isn't already long standing precedents of what happens when a male artist divorces and what happens to his copyrights in regards to his now ex wife. The same rules should apply.

If a law is unreasonable and keeps favoring women and screwing over men, equality-in-unreason MUST ALWAYS be step 1.

If it isn't, the situation will simply remain unchanged for 10-20-40+ years. People like us will keep making noises, saying how unreasonable it is, how things must change, but "somehow" change will never happen. "Somehow" all the proposals will just be dead on arrival, be met with polite nods then end up in the bin.

Guys, this is much bigger then divorce payments. This is splitting of intellectual property rights and trust me ifbI say, nobody should want this. If this becomes a standard men around the world will get fucked even harder. So this article should make nobody happy. Intellectual property was the one thing could take out of divorce pretty much unscaved until now. Think about if George Lukas would have lost the Star Wars IP to his first wife in the divorce, or Stan Lee the rights to Spiderman. This is not good

Your title and the actual article are two completely different things.

This isn't an issue because she's a woman, this is an issue because it's never been raised in NZ court before.

The article specifically states that: "Justice Isac’s recently released decision stated that the Copyright Act and the Property (Relationships) Act 1976 interacted in an unusual way not previously seen in New Zealand law, forcing the Family Court Judge into new territory."

I'm all about working to heal some of the challenges and issues that men face, but when you make up issues just to justify being mad, people start taking real issues FAR less seriously.

Im from New Zealand. I agree that women historically have been treated very badly in divorce proceedings and thankfully there is much progress made here regarding equal divisions of assets. Thankfully alimony isnt really a thing here either.
But i have to agree with the court on this one. The copyright is an asset created during the partnership and therefore needs to be divided equally.

I think they need to look at the ruling a different way.
As part of the separation agreement, they could they could divide the copyrights or ownership of each individual painting rather than splitting future revenues.
Copyright for painting A B and C goes to the husband and then D E and F goes to the wife. If one of those paintings earns money in the future then thats good for that person.
This is a way she could emotionally disconnect herself with the paintings and move on with her life, rather than squabbling over future revenues of all paintings.
Since this appears to be an emotional issue for her rather than a financial one.

There's no hmmm in this article, it's good journalism unveiling an important aspect of a nation's property and copyright law that's coming to light. It just so happens the artist is a woman. I'm certain the article would be the same if the genders were reversed.

This seems like a pretty straight forward news story about a New Zealand court handling a novel issue in family court dealing with copyright.
