Wife and I are soon to divorce. We live in TX. She is in the military and will be forced to relocate next year. She knows she will face an uphill battle to relocate our children if we are joint conservators, and for that reason, I have deduced that she will attempt to be named sole conservator by painting me as an alcoholic. I do drink regularly, but I don't consider myself an alcoholic. I have no legal history with alcohol related issues, I do not drink and drive, do not drink in the presence of our children, no abuse, no neglect of childcare, or anything of that nature. My alcohol use would typically include maybe drinking at most 5-6 beers at night while bored and after everyone has gone to sleep. The next day I would wake up fine, get the kids ready and to school, work a full time job, pick them up from school, dinner, and then Wife arrives home and gets them ready for bed. If not obvious from that statement, I do handle the majority of childcare due to our work schedules, and I have cared for them 100% of the time for extended periods while she has been away for training or deployments.

When I discovered her recent affair, there was about a month or so period of depression where I was drinking more than usual. But still no issues, maybe just stayed up a bit later and then slept in an hour or two later. During this period she was on leave and was taking care of the kids in the morning.

I guess if there is a question in this: what is necessary for her to claim alcohol abuse? What degree of alcohol use would be considered "abuse" or relevant in a custody case? In anticipation of this, I have already cut out alcohol completely. Any other steps I could take to ensure this doesn't become a factor in custody? Am I just being paranoid?
