In their letter, Khanna and Maloney wrote that victims of stealthing can suffer from unplanned pregnancies, STDs and mental and emotional trauma.

With exception of the STD angle, the rest of those reasons apply equally to women who purposefully trick men into pregnancies. So let them pass this, then let the law be used to punish women who pull the same nonsense.

Plus, stealthing really is a shitty thing to do, so it's not as if classifying it as sexual assault impacts anyone doing the right thing to begin with.

You misquoted me a bit. I said that it is ALMOST NEVER enough on its own.

I have worked alongside law enforcement. I have worked rape cases. Most rape cases that are only he said-she said never even make it to court. Many never even end up getting to the police for a variety of reasons.

The fact of the matter is that there are countless rapes where the perpetrator is not punished and countless cases that aren't even brought to the police. For a case to get to court only on he said she said would require either a lot of luck or very compelling testimony.

This is a case where all sides are right, but each group is being too extreme in order to protect they're people who have been treated unjustly.

People get raped. Most of those people are not believed, and most rapist will victimize countless people before they ever get charged, let alone convicted, and most don't even get charged at all. This. Is. Wrong.

Women also lie about being raped, and send people to jail unjustly because of that. (I say women because it's exceedingly rare for a man to even admit to being raped for all the same reasons as women, plus "men can't be raped, they got a boner! A boner means consent!") That. Is. Wrong.

There is Injustice and inequality everywhere. And the only way to fix it is for everyone to stop being assholes and work together.

That sounds like a good system.... That is basically already what we have in place. Eyewitness testimony (aka "he said-she said") is almost never sufficient on its own to have someone convicted.

But even with all the corroborating evidence you mentioned, we still get false convictions.

So my question still remains.

what is a better solution to prevent liars from lying while also allowing the story of true victims to be used as evidence to properly punish the criminal who victimized them?

The only thing that I can think of is to ensure that jurors are properly educated on the accuracy of eyewitness testimony. And maybe a program that would standardize what the accused wears in court (so that noone enters court in a prison uniform, and poor people have access to appropriate clothing so the jury is not prejudiced against them).

Note that these ideas are helpful, but only fiddles around the margins. They don't fix the core conflict that we need to allow people to testify about what they have seen, but that people can still lie.

Eyewitness testimony is imperfect evidence, yes, and it is treated as such. But isn't it still evidence?

I do agree that eyewitness testimony can be taken far too seriously, with tragic consequences. And we should take steps for eyewitness testimony to be not as significant as it is now. But surely you see why eyewitness testimony does and should matter.

After all, how would you feel if you had witnessed a crime but the criminal walked free because the law didn't care about what you saw with your own eyes?

With many crimes, there is no significant evidence other than eyewitness testimony. Should those criminals be allowed to just... go free?

That is... overly simplistic.

It is significantly more difficult to get concrete evidence than you might imagine. I have experience working with law enforcement and DFCS (division of family and children services). In my time there, there were dozens of cases that I personally worked on where I KNEW that there was child abuse going on, but there was nothing we could do because the abuse occurred behind closed doors, was a verbal / emotional, or the parents were too careful.

Many women make accusations with no evidence and feminists instruct politicians to instruct judges to instruct juries to find men guilty. And they do.

How is that fair? How is that "PROVEN" beyond a reasonable doubt? Lets not confuse the ideal of justice with the reality of the courts everyday men face at the hands of fake rape accusers, bitter ex wives demanding alimony, or mothers using denial of access to their kids to get bacl at the father by claiming domestic abuse.

Either there is sufficient proof or there isnt. Why is it so hard tp stick to that? Oh yeah. Forgot. Feminist lobby groups influence and a biased powerful media shaping the legal system.

Sexual assault laws are almost always applied unequally to men vs women. I want some laws relaxed and renamed , I am looking at you statutory rape. Adding new laws and calling them RAPE seeks only to cause an emotional responce and will be used to punish men.

However, this brings us to two points:

  1. If stealthing is rape, then as the OP states, so are lying about birth control and poking holes in condoms.

  2. I guarantee you that women secretly going off their birth control or messing with condoms happen MUCH, MUCH more than men taking the condom off without telling the woman. Yet its stealthing that the media treats as the much bigger deal.

Don't get me wrong, if you do this you're a jackass and you deserve to get into trouble.

But how common is this? I've seen it discussed a lot online and women say, "If a guy ever did this to me, I'd kick his ass." No one ever says, "I had this happen to me, it was terrible."

I'm interested in the frequency because men are often taunted for being nervous about women lying about birth control despite the fact that it "never happens." People even call them paranoid for worrying about it.

It would be so easy to write this as a blanket "if you lie about sexual protection of any kind it's sexual assault or rape." Instead, they just go right to stealthing.

Only if by "in this context" you mean with heterosexual pairings (in which case HuffPo last April). It was apparently slang in the gay community going back to at least 2014.

The fist time I ever had unprotected sex with my then girlfriend, the difference was so noticeable she came within seconds. Same with my wife. I've only had unprotected sex with 4 people and the difference was so absolutely night and day for all of them that its difficult for me to imagine that this is as common of a practice as it is being made out to be.

As far as the law goes...I don't really see the issue here. Any guy that removes a condom after they have agreed to use one is not only risking his own safety and security...but putting his partner in jeopardy. I am actually ok with this law as long as they prove intent. Why the fuck would guys do this, though. Seems really rapey and shitty to do to someone you are going to be intimate with.

As much as I agree that those things need to be addressed, how would one know that someone poked a hole prior to sex? Sounds like a much harder thing to prove than clearly seeing a missing condom after ejaculation. Same about lying about birth control. I guess you could always require blood tests, not that this would be an easy thing to ask.

lying about birth control is easy, you just need them to have a test of their hormone levels (hormonal control is the majority of them) check their arm (implants) or that they have a vaginal insert (IUD).

As for hole in condoms, I have no idea. Same with stealthing. It's so funny how the people who say they want to keep the government out of their lives try to pass stuff like that.

Yeah, I agree that there's means to test if they are on birth control. I just don't know how legal it is to require blood tests or other forms of body fluid. Even if it were done, you wouldn't be taking those tests right away, you would be once the pregnancy is known of, which could be much later than when the copulation happens. Not sure how inaccurate this would make the tests.

Not saying that accusing someone of stealthing would be considered very accurate, as accidents do happen, but it's much easier to identify than the other given examples.

What do you recommend we do to discourage folks from stealthing? Not being sarcastic. That's some messed up behavior.

Alexandra Brodsky, a recent Yale Law School graduate, coined the term in a paper that was published in the April issue of the Columbia Journal of Gender and Law in which she argued that stealthing “should be treated as a form of sexual assault.”

The term "Stealthing" has been about since the 1980's and the claims of it being a recent invention linked to a dodgey sub reddit are pure invention from an incompetant academic seeking sensation.

I don't understand how this could go through any litigation discussion without someone adding in the obvious: apply this to lying about birth control, too.

It's as close to the exact same thing as it's possible to get, STDs aside, and they're both shitty things to do that should ideally be illegal, but are near-impossible to prove.

No, the guy literally hit up the people behind Stormfront to spitball them for ideas on his writeup of what the alt-right is. He's actually pushing Nazi talking points, given to him straight from Nazis.

What a load of invented mythology. There's quotes all over the net from neo-Nazis railing on him for expropriating 'their term' and where they are nailing him for being a Jew and gay. Clearly, when being a member of the two most prominently targeted groups for Nazis in history isn't enough to avoid the Nazi tag, you fuckers will slander literally anyone as a Nazi.

Is it a fact? I'd love to see the specific context, because time and time and time again, you fuckers inflate it, misconstrue it, or sometimes even invent it. The onus is on you to prove the connection, because we're talking gay Jew, here. For a gay Jew to be a Nazi is about as flipped as you get.

30s of Google and I've gotten Stormfront forum discussions nailing him for being a Jew and Gay or where they devolve into a, ahem, Storm of Anti-Semitism and the original Daily Stormer article where they rail on Milo for his piece about the alt-Right.

You should spend some time in Stormfront's forums, actually, because you might actually learn something about your enemy instead of just making shit up.

It's just what I thought. Misconstrual and misrepresentation.

A huge, broad piece about the alt-right means you hit up multiple sources for material. Asking three people from that world for comment because he's defining a movement and they may not like the results doesn't mean he's working with them, colluding with them, or representing their ideals. It's bone stock in journalism to give stakeholders a chance to comment on a major piece that might affect them.

But, because you're sold to the nuts on this shit, you'll ignore that the actual website for the Stormers called him a freak and a mongrel after that piece was published because, what, you only pay attention to the shit you agree with?

Did his piece make the Stormers happy, or sad? Their response was pretty clear. Did he openly and outright disavow Spencer, neo-Nazism and anyone against Judaism or Israel? Absolutely.

You're only see whatever you want to see, sunshine. You're lying to yourself, more than anything, and you're so desperate to smear the fucker as a Nazi that you'll invent whatever you have to invent, inflate whatever you have to inflate, misconstrue whatever you have to misconstrue. You know that Andrew Breitbart worked for Ariana Huffington, helped her found the Huffington Post, and the two considered each other friends, right? Or is that another awkward fact you'll ignore because it doesn't fit the narrative?

I'd actually read it before. Of course, you could deal with the actual issues, here. Did you read Milo's piece? Clearly, you haven't, because if you had actually read that piece on the alt-right, you'd know that he specifically cited the Stormfronters, said they were mocked on the Internet as "stormfags", were isolated, angry little race warriors with few numbers, no influence, and who were essentially pariahs within the alt-right. There is a reason they lost their shit and blew up at him in response.

When We Hunted the Mammoth, about as liberal a blog as there is, can note that Milo and Stormfront have insulted each other religiously then you've totally lost the forest for the trees.
