Sorry to hear. That is brutal. Keep the faith. It may not seem like it but she is losing. When she gets forced back to Texas I can’t imagine the judge will be impressed.

Well she got denied again yesterday, she was not summoned to come back because the district judge did not make the original TRO the associate judge did, so we are having to schedule a hearing to get the possession schedule back in order.

She has to now FaceTime me with the children mon/Thurs/Sat until that hearing

I assume you have filed for divorce in your state and a motion to have your children returned? If you haven’t do that tomorrow. I would be looking for a court order for her to return the kids to your state ASAP. By all means if she is going to let them come for a week take her up on it. I don’t see any harm, but I would be talking with your lawyer about their complete return by court order.

When I was going thru my divorce , my then minor daughter asked to stay with me I agreed , my exwife didn't like it and tried to get me in trouble too, but I was lucky , when her plan to leave the state was found out, my lawyer told me not to let my daughter visit with her mom too since there was no custody agreement in place I could do nothing if she decided to take her, at the same time, she couldn't force me to give my daughter to her, it's all in the timing and in the paperwork

But if she left after the order was placed it will take a while to get her in trouble as that is not really a priority to the police, they might even say it's a civil matter and you have to go to court for that and not to call them.

By default if she left before the agreement was in place well then it's just to late now,.

I hope you get the proof that you need but try to be patient the system doesn't work the same way for fathers than it does for mothers so it will take a while good luck to you

This is a form of kidnapping called parental child abduction and carries felony charges in basically every state. Contact the child abduction unit at your local DAs office. They will likely have you file a police report at the local agency to forward to them.

Your local DA should coordinate with the DA of the agency where your kids are and facilitiate her arrest for an out of state extraditable warrant and getting your kids back.

Press charges. Criminal convictions can always be used in family court.
