Are we correct to assume the house was appraised at $380K, it was marital property and since there was no mortgage she was ordered to compensate you for half its value?

Also assuming she didn't have the $190K so she was going to use half the distribution of the 401K (again, marital property) to pay you off?

Just guessing here, but early distribution of the contents of a 401K includes a mandatory 10% penalty in addition to the tax (depending on the age of the recipient... those over 55 can be exempt) unless the proceeds are rolled over into another account. Her penalties and tax may exceed the $190K. That's not your problem, but it may be an explanation. She should take out a mortgage to pay you off if this is the case.

Why would you not just do the subtraction...? Give her 60k and keep the 190k...
