This is a standard she does not like what you are doing. So she wants to amend agreement. The contempt this is a side show, most likely filed by her new lawyer to show off.

Eh go to court and see if you guys can negotiate something outside the courtroom would be my advice. Usually you getting a lawyer to talk to her lawyer means the trial will not be a slam dunk so the other lawyer may negotiate with you.

work out to be something like you lose holiday flexibility but keep the 10 day thing. She gets something you get to keep most is probably the result.

She figures out it's TOUGH to get movement on your agreement already in place. Give you a couple of years of peace until she gets another silly idea to take you to court.

Ex-wife filed a petition alleging a "substantial change of circumstances" given that she got a new job and bought a new house (this has not materially changed our geographic distance apart, we live around 15 minutes away from each other both before and after this change) and that these changes of circumstances warrant a modification in timesharing, namely, the elimination of the four additional overnights.

She’ll lose. Don’t interrupt the enemy while they are making mistakes.

She has to prove a substantial change in circumstances that impact custody. She may have a new house, but that doesn’t impact the child or custody. She may have a new job, but that doesn’t impact the child or custody. Substantial changes in circumstances have to pertain to the child. If you had moved away, say for instance you moved to Colorado, that’s a substantial change in circumstances and should lead to a custody modification. Her new job and her new house don’t mean Jack shit.

Let her make a fool of herself in court. Stay out of her way and insist on the status quo.

It’s understandable that you want to see your kids as much as you can. Commendable even.

It sounds like you’re taking advantage of the situation in some ways. Many times, the four additional day option is written into a 50-50 custody agreement to accommodate for times when you may need access to the child on days that are scheduled to be hers. It’s not necessarily written in there to give you for extra days whenever you want. For a 30 day month, the child is staying with you for 15, with the extra for your taking from her, she only has the child for 11 days. If she was reducing your custody by almost 30% every month you would understandably be upset also. My advice would be to stick to the schedule, stop taking advantage of the four day exception, cleared up with her, skip the court trial.

Well I've been in the court system for a long time .I adopted my twin nephews when they were 18 months old I had to take custody of them ( parents went to jail then prison for drugs ) . Needless to say after a few years it was obvious they cared more about drugs than the kids so my wife and I adopted them .now they are 22 yrs old . I don't have any idea why your ex would pull something like this and get lawyers is in it for just money obviously.

The courts hate when one parent pulls shit like this because she thinks that taking your time away from you will hurt you in the long run more or less using your children as a weapon . To upset you I don't know why you ended up divorced but she must have some kind of vendetta against you for doing so .

I've seen some fo to court and tell the judge complete lies saying he abused me or he is a drug addict or a pedophile.thinking they will get there child 100% only to have it backfire and lose all custody of there kids and the father walks out with his kids then they are sent for a mental evaluation. So it can come back to haunt her .she thinks she can walk in a court room and pretty much say the first judge that made the final agreement was an idiot or not doing his job will piss them right off

So just don't fall for anything other than what's in place now the only one she is hurting is the children .date so long kids start to think that the divorce was caused because of them .

Are they days you have your son documented? So basically you have 50/50 plus 4 extra nights per month which you regularly use because your a good dad. Unless I’m missing something her complaint sounds really stupid, I wouldn’t even involve my lawyer I’d simply tell her to fuck off.

Edit: involve your lawyer and don’t tell her to fuck off.
