But it turns out a few beers won't impair you enough to 'take away your consent' -- a certain BAC level and level of intoxication certainly will, and it's usually plainly obvious. If she's slurring her speech, has difficulty standing and walking, etc ... then you are in the danger zone.

I feel like pretty much all guys are aware of this, without having to physically do a BAC test. Girls are generally aware how they drunk they were the next morning, to. Well, usually.

So basically, you have to intentionally be a malicious asshole to try to sleep with a girl who is falling down drunk, or about to pass out. Again, it should be pretty clear. If it's not, I'd err on the side of caution for your own benefit.

I haven't been to this subreddit in years. And this question has drawn me to actually post. The short answer to your question is this: because in the real world(read "outside of college campuses"), girls and guys can drink alcohol, give consent to have sex and it still counts. Please don't fall victim to the "any alcohol means rape" nonsense being spread throughout colleges nowadays. And here's why it's nonsense; in the common law, there is a concept known as "reasonable person standard". Basically, the point of it is to bring some common sense into the interpretation of the law; would a reasonable person consider the situation as a violation of the law and the accused a danger to society?
This is very important, because this is where the difference between "black out drunk" and "had a couple of drinks" comes into play. I strongly doubt that any prosecutor will take on a case, or hell, even any detective will seriously pursue an investigation where one partner admits that, yes, they did give consent, but it totally doesn't count because they had two shots of whiskey that night. Keep in mind that unlike on college campuses, the burden of proof is on the state and they have to prove beyond a reasonable doubt that the accused is guilty, not the accused has to prove that he or she is innocent and can't question their accuser. This is something prosecutors keep in mind, because they have no interest in going to court with a case that will be picked apart and thrown out; they are busy people and they have real cases to prosecute.
Now, how do you establish if someone is too drunk to give consent? Or rather, how do you establish that someone is sober enough to give consent? Well, a good rule of thumb is that if someone is capable of making a financial transaction, that person is sober enough to give consent. Another good indicator that the person of sound mind and judgement if there was talk(preferably in writing, as in text messages) of safe sex, something as simple as "do you have condoms at your place or should I pick some up on the way?" will clearly indicate that the person responding is still capable of making rational decisions and is fully aware that they are consenting to have sex.
None of this will guarantee that you won't get accused, but it will establish a really good defense case for your lawyer, if there is a prosecutor out there stupid enough to take on a case like that, which is unlikely. There is a level of intoxication where it is plainly obvious that a woman is unable to give consent. This is a state in which she isn't sure where she is, who you are and what is happening. Chances are at that point, she will be passing out or blacking out.

This is not a level reached at normally in a bar because bartenders and bouncers will usually turn someone away before they get that drunk.

Besides, if you are worried about consent because she is drunk, let her make the call later on when she is sober to proceed. That's always safe.

People can still give consent while intoxicated - it's not until they're incapacitated that they can't give consent. importantly grey word there. If they're not able to make conscious decisions, you shouldn't have sex with them

Because intoxicated doesnt me shit faced, intoxicated just means they have alcohol in their system, how much isnt described by this term. What you are worried about is very intoxicated women who have too much in their system to consent, you can tell how intoxicated they are though and obviously if they are barley able to stand up or almost unconscious or obviously heavily intoxicated then they cant consent, neither could you if you were just as bad. If they just have a few drinks, are talking fine, able to walk themselves around they can consent, please get this bullshit femenist idea of "women cannot consent if they have any alcohol" as its really just degrading to the ability of women and is a bullshit way they want women to be able to charge with rape if they regret what they did regardless if they consent.

Point of order: "being intoxicated" does not instantly equal "being unable to give consent." You KNOW that there are different levels of intoxication.

So I dispute premises of your question: Being at a bar does not instantly turn intoxicate girls to the point of being unable to give consent.
