Never take legal advice from your enemy in a legal battle. That's the first thing to stop doing. Her written promises to you mean nothing in a future divorce proceeding. Get a lawyer and stop simping to this woman!

There are also mediating attorneys. Their job is to represent the dissolution of marriage. Your papers will list one person as the respondent and the other as the main character forced because of law. Mediating attorney will advise both of you right and what makes sense. This is actually a very good option if your wife and you are on good terms. It is much less expensive. And can take on many of the diverse issues of a complicated marriage. As an example, my wife and I divorced after a 40 year marriage. We used a mediating attorney and were able to create a settlement that was fair if not slightly in her favor, but that was my doing. Total cost was $2800.for everything. It is a much better process, but the key is that the mediator is an attorney who will then draw up all of the right documents for the settlement, the house, car transfer title, etc..

Something tells me she has retained a lawyer for some time now. Get a lawyer ASAP and learn what your options are. I don't know if you have kids, if you have a business, you make more money and how much more. If you make roughly the same amount, no custody issues then mediation would be fine IMO. Either way you're going to pay something. If your case is more complicated I'd shop for a good lawyer.

You should take the other half of the money out before she really gets greedy.
Consider removing any valuables from the house “for safekeeping.”

If you do decide to go the mediation route make sure you do so after you receive advice from a good local divorce attorney so that you are aware of your rights vis a vi assets debts and support. In divorce you are generally entitled to half of the marital estate which is all property acquired during marriage other than that which was received by gift or inheritance. Also it may include any separate property that got commingled with the marital property.

This is what she has done. And whoever advised her is a moron. The courts don’t look favorably on the party that does this.

And as far as “stuff” goes - it’s all trash. I took my personal effects, clothes and tools. She could have the rest.

Yes a lawyer would be better. A mediator is basically just a referee to try and keep things civil and work to mutual agreement.

Was this just out of the blue or have you been having problems? Have either of you actually filed for divorce? Do you have kids, own a home, ect? If so I would definitely look into at the very least seek a free divorce consultation.
