Evening, all. Just want some feedback. I know overall in my state that money earned/invested in during separation is not on the table during asset distribution. However, my wife is not agreeing to the divorce and declines to accept we are separated. To make it complicated my state doesn’t have bona fide legal separation. You are required to sleep apart or live apart for year prior to filing for divorce. I chose to move to the guest room after being hit, slapped, scratched and you name it after several times in our marriage. I know I could have called the cops, etc, but she’s beyond crazy. Last time I wanted to she threatened to harm herself if I did and blame me. I think she had BPD to say the least. But finally, she’s coming to terms.

The one year period has been up for a while. I chose to stay in the house due to stbx not being able to pay the mortgage. We live in a high COLA and I can’t afford rent, mortgage and lawyer fees. She’s already looking at a hefty alimony, child support and cash pay out from my savings and 401k (we have separate finances). I had some stocks I wanted to invest in, and wanted to know if y’all had any issues during settlement negotiations if you invested after being separated? I’m sure she will get a bull dog attorney that will fight for every penny. I just need extra bread after this shit settles.

I know I’ll get the comments about asking an attorney, and he said I was fine - but at the end of the day I feel like they are all optimistic as long as you keep paying the legal fees
