Advise I've given before: Get a paternity test if possible, birth certificate for 16 yr old, proof his bio dad takes care of him etc. Unfortunately stats are against you, the married man is usually on hook for CS for longer term marriages. In fact 95% of CS is agreed upon during divorce. Unmarried dads are rarely hauled for CS

You're going to need to fight this tooth and nail, they can and will likely assign you as the child's father because the court does what is "in the best interest of the child" or claims to, at all times. Having someone assigned to pay child support is unfortunately in the best interest of the child.

This is 100% why men should never ever date or even marry single mothers. Sorry man. Don't even meeting their children if you risk dating them.

What she is going for is known as an "equitable parent" for her child. This doesn't have to be in the law for you to become one.

You can be ordered to pay child support without being on the child's birth certificate - I was - but I am my child's biological father per my own DNA test. Court couldn't care less that another man full-on lives with my child's mother and has most of the child's life.

As an aside, brother, it is for likely only 2 years... might be just cheaper to accept it and move on. A serious legal battle will be 10-20k and then you're still likely to lose.

Depends on how long you were married. If the Bio-Dad has never been on the hook for CS or visitation?

And then you stepped into a father role for x number of years? The family court judge might make you responsible for CS until kid turns 18.
