My lawyer had us get a vocational evaluator that basically testified that my ex could be making $XXX. The judge didn’t accept it but I still think it’s a solid strategy.

As far as the abuse allegations. Two things 1) in divorce the judge only needs a preponderance of evidence which means they believe it might have happened and 2) pushing definitely meets the criteria, mine was the ex had shoved a phone in my face and grabbed it and threw it. There are lots of weird little “if there is a preponderance of evidence that abuse happened then the judge can decide _____” in the law. Like because of mine my ex has tie breaking authority on parental decisions. because I don’t meet the criteria to lose decision making so the judge functionally took it away. The only caveat is my ex has to discuss the decision with me before she does whatever she wants. So I would be careful what you admit to.

Alimony sucks and I hate it but I call it “(ex) can’t live without (me) money” when I’m being petty.

Fortunately, you're in texas. For a short marriage (no kids?) and she has an advance degree, likley no spousal support. Even if she doesn't work currently, she would be imputed.

Confirm with a local attorney, but a judge should not order.

She won't get shit for alimony in Texas with a 3.5 year marriage and a master's degree. Laugh in her face and say "let's see what the judge says". Texas is one of the best states for men alimony-wise as it's 3 years max "rehabilitative" and that's for stay at home moms in 20 year marriages. In this case she won't get a dime most likely.

From my own divorce if it's less than 10 years she has basically zero chance in Texas. I'm not a lawyer and you should talk to your own, but it would be in your interest to keep any documentation that shows she is just not trying to support herself. Text messages, recorded conversations, whatever you can basically.

Apple watches can be setup to record audio with a single button press. Pretty easy to record when needed that way discreetly.

Worst case they will make you pay a fraction of your marriage term. Move on dont lose sleep over it. Certainly dont make the lawyers rich over nothing.

You have very little risk. Worse case scenario is that you pay rehabilatory alimony to get her on her feet. I do not know Texas.

You probably need to consult with your few attorney in your area. If alimony is ordered by Judge, its gonna be for short time period cos of the short marriage year.
