Anything earned and accrued from wedding date until divorce is marital (so if you now have $20k more equity in house, that can be split). It's a short-term marriage so it's more in your favor than not.

Assuming you don't have kids, this is a financial transaction. Unfortunately, in litigation, the litigious party has an advantage because every 6 minutes with a lawyer costs you. So it could make financial sense to throw her an extra $10k for a nuisance settlement because the fight could cost you more. I don't know the specifics of your situation, but a decent attorney could say "a full on fight could cost X, she wants Y to settle, and if Y is less than X... well, it sucks but it makes sense".

Personal injury lawsuits do the same thing and it's why when you apply for home insurance or other forms of liability insurance they now have central databases of claim history. You slip on water in a store and hit your head, it makes financial sense to throw $5-$10k at someone to make them go away. They do that every 6 months, you know you have a career litigator and its time to push back. That isn't really plausible in divorce (because if you've married someone divorced 6 times, your kinda asking for it).

Yes, equity on the house will be split in half, except whatever equity she had in it prior to you getting married. So, you will get less that half of the sales price, but you also didn’t put the down payment, previous mortgage payments, etc into it.

Start getting all of your old mortgage statements, checks showing that you paid it, and bank statements together.

Divorce is a paperwork battle.

I’m in this situation but on the other way. Owned home and business 15 years prior to marriage, but my wife never paid one cent towards anything. I am lucky the house is in mine and my father’s name. I am basing my entire case on that she came into the marriage w nothing, we have no kids, married 6 years, and she grossed $28k during this time. I will not pay her more than her gross income during the marriage. I’ve already had to pay her more than that for maintenance and I’m seeking reimbursement. I had to give her something so she would have something to lose, she is totally pathetic. Also cheated on me and had a baby during this entire time.

That is good news.. I hope you get it and that she doesn't take forever getting it to you... U know if the situation was reversed she would definitely go after you for the money..

Yes, the increase in home equity from date of marriage to date of separation -- 50% of that increase in equity is yours.

In Louisiana u should get half of principle payments from the time of marriage to the time of filing for divorce.. u should be paid half of the money you paid on the mortgage throughout the marriage. You will need to show you made payment on the house. Even if she owned it but u paid the mortgage you should get half. I'm in a reverse situation and about to pay 18,000$ to her from the house I owned before marriage.. she never helped but we were married... Not sure if Texas is the same..

No, you’re not going to be reimbursed for bills paid with marital funds. Half the equity in the house is yours though.
