It looked at 67 cases with male perpetrators and 5 cases of female perpetrators. That's not a lot. That doesn't mean that the finding is necessarily wrong, but we should be cautious with it, especially considering the fairly large body of research out there that's looked at far, far more cases across different types of crimes and found that men are sentenced more harshly than women, and that crimes against women are sentenced more harshly too (all after controlling for type of crime, severity, criminal history, etc.). One of the studies there says that men's harsher sentencing "may be one of the best established facts regarding criminal justice outcomes".

It's possible that this is just the general trend and for some reason intimate partner killings have the opposite bias, although I have no idea why that would be the case.

If its specifically a study of murder rather than including all cases where a partner killed their partner then the study is fundamentally flawed.

The prosecutors decision to proceed with murder (intent to kill) charges rather than manslaughter (intent to harm that resulted in death) would greatly affect which cases the judges are sentencing.

If the prosecutors are more likely to charge a woman with manslaughter rather than murder then this would mean only the worst cases where a woman killed their partner would be in this study. Its common for prosecutors to upgrade or downgrade between murder and manslaughter based on their own judgement.

Also, consider that women against whom the state doesn't have the strongest case likely don't even get charged with murder to begin with.

Also, consider the vast bulk of research points at the opposite trend, with much higher sample sizes. This... piddling little Australian affair is hardly a refutation.

Wow. ONE cherry picked "study" from Australia; and we're to believe this completely and totally negates the pussy pass.

We're not told any of the circumstances of the murders the perps committed. We're not told whether any were 1st degree (premeditation and deliberation) or 2d degree (crimes of passion) or even whether there are any differentiations there in Aussie law. The sample size includes only 5 women; with the rest (67) being men. We're not told whether trials were involved or pleas made. We're not told who went to trial and who pleaded out.

Philip Davies MP thoroughly debunked feminist claims that women are treated more harshly than men by the criminal justice system in a UK parliamentary debate a few years ago and again more recently. The man has done his research.

Was just commenting on the other thread about this. It think there are too many variables to be able to come up with an exact reason as to why there appears to be disparate treatment in sentencing (in the U.S. it's more favorable to women vs. men).

The best studies would look at specific crime committed by men vs. specific crime committed by women and would try and keep the facts as alike as possible so as not artificially skew the sample (so for example, don't just compare net murders committed by men to net murders committed by women because my bet is there's so many fact-specific differences between murder cases to make it meaningfully accurate as to gender bias).

If you break it down as specifically as this study attempted to do (murder of a spouse while controlling for race) you're more likely to get an accurate picture. My guess is there are relatively few crimes where sentencing favors men but then again this study's results surprised me. I would have thought the whole "the husband protects the wife" stereotype as well as the media's attention to the problem of domestic violence (usually portraying women as the victims) would have shown the opposite results. Than again, it could just be different in Australia.

Probably the crime I can most see as being more favorable to men vs. women would be child abuse and murder (not sure about sexual abuse though). Simply because women are moreso perceived to be the "nurturing mothers" who should protect their kids. This is likely one reason why high profile cases turn to metal health/insanity defenses because a jury is more likely to be lenient if they view the defendant as a victim too. (Another reason being that people don't want to believe mothers can murder their children without being fucked in the head - hello the reptile effect).

Women are rarely expected to be the perpetrator of a crime (especially murder) so if they actually commit a crime they are judged more harshly for it.

There are nuances to the 'Women get shorter jail sentences than men'. I read a report someone posted recently. Overall, they do on average but about half of that is because they plead out at every stage of the process more than men do.

Also, when crimes were controlled for, women who were mothers received harsher sentences than men. There were differences between men who were fathers and those who weren't. It seems that judges (who last I checked were mostly men) allow their own prejudices to influence the sentence, depending on their expectations on the plaintiff.

The study s pretty small. Nothing to blow out of proportion. But it does say something about how some Australian judges deal with cases of domestic murder. Which is not very equitable at a glance.
