If you give her 10 years of prison then you teach everyone that killing their children is okay. Punishment is a deterrent to crime. If you wouldn't go to jail, everyone would steal or murder to benefit themselves.

People like to talk about rehabilitation as though it's a catch-all solution, but what percentage of those who are rehabilitated will become repeat offenders when released? Is the amount of money invested in rehabilitation offset by future taxation and early release? How much is crime increased due to more lax punishment? And while it may theoretically be beneficial economically to rehabilitate someone, is it necessarily just? If I terrorize a high school, but go through 10 years of rehabilitation, potentially feigning my way through, should I just be released back into the public?

Besides all that, there's a decent chance she'd be given early release from her 45 year sentence. I personally don't think 45 years is too long.

We have a huge problem in the USA with over sentencing. We imprison more people, and for longer, than ANYWHERE in the world. It's not just over doing it with drug offenses, but everything across the board.

People use your same logic with all sorts of things... Someone stole? Send him away forever! Teach other thiefs the consequence of theft and how it won't be tolerated! But eventually there is diminishing returns on sentencing. Sure, giving someone 6 months for say, robbing someone at gunpoint, but 50 years vs 10 years, is going to have no different impact on social impact. At a certain point, people don't care about the consequences. They know they are fucked regardless if they get caught. To most, 10 years may as well be a life sentence since it'll take away a whole portion of your life. People at this point stop caring about the severity of the sentence.

We have hard data backing this up. All it does is create more social problems with our heavy handed sentencing. We've been increasing our imprisonment rates and lengths since the early 80s. How has that been going for us? Has it really been worth it? To spend the last 30 years just giving huge sentences not seen anywhere else in the world? How are those more "liberal" countries managing to get by with 10 year caps?

The thing is, sure, SOME people are going to feign their way through and get out, and still be evil. But most wont. At 45 years, you've given up. That's it, you're done... You don't care anymore. You're in forever. At 10, it's still extreme, but at least you'll be able to get out and live a life, so you are more likely to reflect and seek redemption. Especially if it involves being monitored by the government afterwards.

I should have known that this would be pitched as a gender issue in here. : ) The rest of the world is far more preoccupied with racial equality. It would be fun to find out if black men are doubly fucked over as compared to white women -- which would not stand to weaken my original point, only to invigorate it.

I should not have used the term 'oversentencing', because that conveys an accent on the length of the sentence, whereas a significant aspect of the problem is increased incarceration rates (although coupled with more lengthy sentencing, as your source still points out, amongst for example the Pew Research Center) for black people as compared to Caucasians. And although a quick search thankfully results in several articles pointing out the gap is diminishing, as it should, the US still has a way to go.

Also, although I haven't read the paper yet, I hope they have corrected for the type of crime. Men are far more likely to commit violent crime, and in far more extreme ways. In the old-school way of looking at incarceration having a deterrent effect that also results in 'demanding' heavier sentencing for males as compared to females, traditionally.

I'm not saying a few years.... I think 10-15 with extended monitoring afterwards seems more fair. Hell, even 25 years...

But yes, I agree with it being a bigger problem amongst blacks. The justice system sort of has a racist idea that punishment is subjective and to get the story across to ghetto blacks, with criminal records, etc... require long periods. Whereas a rich white guy is enough to learn their lesson just going through the process for a few days. Insanely broken.

You also have the other issue where law enforcement actively looks for criminals. When I lived in DE what I loved was when police would encounter a situation, they weren't there to write tickets or arrest people, just to break it up, resolve it, and calm people down. If no one was complaining about something, they weren't actively trying to rock the boat. For instance, EVERYONE knows where dealers hang out selling drugs on Revaler strasse outside the club entrances. But cops aren't forming units to come around and arrest everyone. Instead, they'd just occassionally sweep through, to get them out of the area, and make arrests only when there was violence or serious theft. Other than that, it was just sweeps to maintain order.

Not in the US. They are actively trying to arrest people. So they go to areas and dig around to find people... So much as just riding a bike late at night in a poor neighborhood gets you harrassed by cops. Naturally, blacks are the easiest targets.

I don't mean death penalty for the economic reasons, but if we feel like there is no ceiling for retribution when someone wrongs us... Why even bother with 45 years? Just kill them. Give the victims the max affordable for their revenge, and be done with it. Why even pussy foot around with 45 year long sentences? The person's life is already ruined, so just kill em, and make everyone happy -- since that's clearly what it's about.

I am not trying to defend her, but we really don't know. People don't start out doing these sort of things, the nazis weren't all sociopaths. It's a slow progression and normalization. It doesn't mean she's without redemption. She definitely owes society, but it doesn't mean she'd continue doing this again if only given 12 years.

But if it's considered a lost cause, and this person is just pure evil. Just kill them. Don't bother keeping them around. Give the people the blood they want. We clearly aren't trying to be civil and just looking for revenge, so may as well give it to them rather than half ass it.

Yeah, situations like this make it hard to have these conversations. Like, I think everyone will agree that we have an oversentencing and harsh justice system... But that all changes once the crime personally pisses them off, then suddenly these same people want the most extreme and harsh punishment possible... Then wonder why we have such lengthy and harsh punishments.

I just don't think sending someone to jail that long creates any value. None. It is just for revenge and retribution's sake. Russia has caught spies in the past and sentenced them to 3 fucking years, with 7 years monitored release... Fucking spies... And this is fucking Russia! Across the board, while this shithole fuck of a country is a shithole, even they don't have as extreme sentencing. And lets not even start on some European countries who have caps on the amount of time. Because they realize there is diminishing returns at some point. That a long life sentence really doesn't do much.

I don't think we should solve the problem by making examples out of people... All that does is feed into the puritan retribution model. We can solve these problems without making extreme examples out of people. We have a very very very serious problem of imprisoning more people and for longer than ANY country on the planet.

We do it so casually, and for so long, not even putting any thought into it because "Errr they are bad people and make me mad! put them away for as long as you want!"

All it does is feed into a negative cycle.

However, I'd be more happy with a halfway solution too... Where maybe they do get these long sentences, but after a short amount of time they are placed in a bordered and controlled minimum security place... Where they are still removed from society, but aren't spending it in concrete closets for 50 years.

The type of prisons we have, as the norm, are considered the extreme for the worst most violent and shocking offenders in most other countries. I'd be more okay with the sentencing if they could at least have senses of autonomy, like their own rooms, daily activities, and purpose. Rather than what we have now which is a lifetime of degradation, violence, isolation, and no selse of autonomy.
