I agree with the analysis in this article, but people in the comments are pointing out one important aspect of this story that hasn't been touched on: how did he feel about the situation? if he didn't feel that he was raped, she may be innocent, even though a court could find her guilty of sexual assault based on his level of intoxication.

Well, laws don't give exceptions because someone isn't mad about it.

You can choose not to press charges in a civil case, but not in a criminal case. That is in the hands of the court.

If someone commits statutory rape, the charges come regardless of if the victim wanted it.

So I highly doubt the dude's opinion matters on the nature of if a crime was committed.

The only part you can really say the guy would be needed for the criminal case to be properly prosecuted. You'd need him to cooperate, but he is obligated to do so when a crime is reported and he is called as the only witness.

right, but this is where the disconnect between ethics and law sometimes comes into play. if the victim doesn't feel like a victim, or that he was wronged in any way, charges are brought regardless. is it moral to continue due process in this situation? maybe.

I do know that if the genders were switched in this situation, the guy's life would already be ruined, and chances are decent that he'd end up in prison.

The thing is that many feminists say that alcohol automatically prevents the drunk person from giving consent. So if the roles were reversed and she was the drunk one asking for a booty call from a sober man it wouldn't matter what she was doing or saying, they would call it rape.

so, are you referring to this actual situation where you're calling us nancy boys pussies? or this sub in general?

if you're talking about this situation specifically i think you're probably wrong, but i dont know enough about this situation to be 100% sure. i think if the male in question actually didn't go into the situation looking to have sex, then that's absolutely fucked up and either way where it ended up (her having to wake him up to keep having sex) is definitly wrong, and it doesn't matter the gender. if you think it's being weak to complain about being raped, or be outraged that someone was raped, then there's probably no where else we can take this conversation.

if you think that the male went into the situation looking for sex, which you could definitely make a case for, based on Shumers story, and you're upset that everyone is now crying rape on behalf of some dude who was looking for sex in the first place, then that makes sense. i disagree that there's enough evidence to say the dude was looking for sex, but i wouldn't hate on you for feeling that way.

if you're referring to this sub in general, i think it's probably a huge overgeneralization, there's probably legit situations and BS ones but i don't really care either way.

If I were to make a case, it would be that the dude wanted sex. I absolutely do not believe that she raped him. Part of the reason for this sub's existence is that many of us are tired/sick/disgusted by modern feminism and the ridiculous SJW movement.
