Emotional abuse shouldnt ever be a defence to murder, physical abuse i can come to terms with, emotional though, if there is no fear for your own safety (in fact life or serious harm - which should be judged objectively) then there shouldn't be a defense

Not even, we have the police for that. If you're a victim of abuse, whether it's physical or emotional you should go to them (although if you're a man you might not want to because they might assume that you're the abuser), the only reason there is for killing someone would be if you were in imminent danger, and you were stopping them from harming you.

I think we're probably just talking about different things when we say "abusive", and may quite possibly agree fundamentally?

I don't think being a bit mean to somebody should be considered high enough to gain the "abuse". In the same way that if I repeatedly poke somebody in the arm, I'm an annoying twat, but I'm not physically abusive.


I'm only considering a higher level of things abusive. There's more things than threats. For example:

Gaslighting is a technique whereby false information is fed to a victim over time to disorient them, and make them doubt reality. Eventually, the victim will believe themselves to be unreliable and crazy, and will believe whatever the abuser says over their own memories or perception.

Isolation - the victim may not be allowed to have friends, or leave the house. Alternatively, they may be cut off from means of support, or their family/friends. This could be threats, but can be through lies to turn people on each other, etc. The victim becomes reliant on their abuser.

Playing the victim - false accusations etc., don't believe I need to say more than that in this subreddit.


Whilst I don't believe it's possible to criminalise such things (due to it being tricky to know who the abuser is), I certainly don't think such things should be considered a protected freedom of speech! This is the sort of thing I'm thinking of when the "abuse" term comes up.

Well physical abuse isn't a valid defense for premeditated murder, but if in the heat of the moment while defending yourself, your abuser hits their head and dies, it would totally be a valid defense. Anything not pre-meditated would basically use the physical abuse as grounds for self-defense.

You shouldn't. Not if you're living in a place where any semblance of rule of law already exists.

In France, feminists -and naive conservatives alike- are demanding that a woman who shot dead her abusive husband and was consequentlysentenced to 10 years in prison be pardoned.

Her murder was committed out of spite, outside of actual immediate self-defense (but some time after an altercation between the two of them took place), and she had never tried so much as once to press charges against her long-time abuser.

The underlying message is not concerned only with this particular case. Look at the bigger picture - it's about feminists asserting that women claiming to be PTSD-ridden because of domestic abuse have a right to perform extra-judiciary executions of people they have labelled abusers (whether correctly or incorrectly).

Don't fall for this trap. Don't give other people the right of life and death over you, or anyone else they might claim is a bad guy. Bad guys do deserve to see the inside of a cell if/when properly arrested, tried and convicted, but not to be killed outside of due process because their spouse said so.

Besides, as the son of a woman who actively chose to stay in relationship with a long-time abuser against the supplications/advice/intervention of pretty much her entire family, the local government, police etc., I witnessed first hand that domestic abuse is almost always more complicated than the "poor woman being beat up => retaliates by killing husband => justice is done" narrative that too many people buy into.

So, self defense then? One does not "come to terms" with self defense. It's there, it's already enshrined in the law of every country and the natural right to defend one's life has to be the fundamental starting point in political philosophy since Thomas Hobbes.

Anyway, that much was unclear from the comment I responded to. There is a very real difference between imminent self defense on the one hand, and on the other objectively "fearing harm" (on the grounds that abuse had already occurred in the past, and therefore is potentially a credible outcome) even whenever actual imminent harm isn't forthcoming.

My point was precisely that feminists are running initiatives to blur the lines between the two.

no by physical, iim refering to the idea that if they are attacking them and fight back and they kill them then sure, fuck it, there own fault for attacking them, but the moment they claim "he was being mean to me so i stabbed him" fuck them -.- (im not talking about attacks that are premeditated and planned, im talking about at the moment of supposed abuse, and they fight back, killing them, if its a physical attack it's justified (so long as it was a reasonable in the situation), but if they attack them (or as they will claim fight back) because of an emotional attack, but do so physically there cannot be any defence (besides actual mental illness, but that should be atleast 5+ years in a mental home or until they are better which ever is longer - atleast))

Dont get me wrong im not saying "oh he hit her 3 weeks back so she stabbed him" its okay, no, im saying "he starts attacking her, she pushes him back and he falls breaking his neck" shouldnt be punishable, just like it wouldnt if it were a normal attack - you uphold the normal rules and dont create new ones for domestic situations, as to do so leaves you open to your emotions. the way i worded my first comment was bad.

Emotional abuse can lead to people killing themselves. Just like physical abuse.

Still, killing someone(death sentence) is only excusable for those who purposely kill others.

A threat would have to be enough to cause a reasonable person (based on circumstances) to think they would actually be killed and even then its dubious... For instance if I said "shut up or I will kill you" but id never touched them before or anything, they'd have a hard time saying "everyone would have feared for their lives" sorta thing

If you truly feared for your life you would immediately flee. What you wouldn't do is wait around until your husband had gone to sleep then stab him to death. Waiting around proves you were not in fear of your life therefore self defense fails.

Different triggers have different weights. There are hair triggers, and there are heavy triggers. I have a nerf gun that has a heavier trigger pull than a handgun I own. The fact remains that you can't "accidentally" pull the trigger of either.

No but you can kill someone who steps out into the road at the wrong time. You can bump into someone in a train station platform and cause them to fall in front of the train and you can accidentally scare someone with a heart condition and trigger a heart attack. I didn't mention guns.

They're allowed to live their lives eating lower than high school quality food in a 2 x 2 unit of concrete and have to listen to screaming, violence and illness. Lucky to get a window unit... That isn't life. Especially when all calls are monitored and you can't get visitors if they weren't scheduled two weeks in advanced, no weekend visitors and you are an unpaid laborer

The no weekends and scheduling may change in other prisons, but that is the local prison I am familiar with. They feed you so you never shit.

Glad that she went away. I remember one of those TV shows maybe 10 years ago where they it covers a whole trail to sentencing. #1 subject was a woman who shot her husband in the chest with a shotgun and tried to make it look like a suicide. Of-course, she pulled the abused victim card with no real proof beyond her sayso. Next case was a man who was the worst offender in the state for failure to pay child support. The child support guy actually got more time.

Verbal abuse IS abuse... But try imagining the amount of verbal abuse husbands take everyday across the planet. The stereotype is the woman nagging the husband for 5 hours until he starts yelling and slaps her.

The slap can land you in prison, the 5 hours of nagging cannot. Not saying that's fair, but that's how it is. Doesn't matter how much he/she verbally abused you. Killing them is rarely justified.
