Pre-nup survives wife's challenge, female journalist reports it as "man stiffs wife out of alimony and wins right to throw her out" --> Are you telling us that a contract isn't a contract when a woman signs it?

Alimony is a relic from the dark days of the patriarchy. It should be ended completely ... said no Feminist ever.

Marriage: Not even once

[–]Niketi 29 points30 points31 points 10 years ago (0 children) | Copy Link

This archaic bullshit needs to be abolished.

[–][deleted] 38 points39 points40 points 10 years ago (3 children) | Copy Link

Women wonder why men don't want to get married.

Men read articles like this and think "That could be me" or "What if I couldn't get the decision overturned on appeal" ...

Men aren't stupid, ladies.

Feminists have rigged the Divorce laws to make divorce a wealth transfer from men to women.

Men are, rightfully, avoiding putting their neck into the guillotine.

I told my gf I'm not planning on getting married again.... it doesn't mean I won't necessarily be with her the rest of my life, I simply don't see anything to be gained by getting married. Her mother asked me "What are your intentions for my daughter?" And I told her my intentions are to be in a relationship with her as long as we both want to be.

What are the common-law marriage laws in your state/country?

If you do not know, you should check into it.

[–]manicmonkeys 9 points10 points11 points 10 years ago (0 children) | Copy Link

Just one more thing I love about NH. Common law marriage only exists regarding inheritance/estates, and even then, you have to have been living together at least 3 years, call each other husband and wife, and be regarded by your general community as husband and wife.

Pretty solid law if you ask me.

Slavery.

[–]DillipFayKick 20 points21 points22 points 10 years ago (0 children) | Copy Link

Wage slavery is real ya'll.

[–]brokedown 17 points18 points19 points 10 years ago (1 child) | Copy Link

That is scary as shit. The entire concept of perpetual alimony seems insane, the ideas that I could marry someone who later decides they would rather not be with me for whatever reason, but I'm still on the hook to finance their lifestyle forever, potentially beyond when I would retire... Florida just failed to overturn perpetual alimony, my girlfriend knows we aren't getting married.

[–]SigmundFloyd76 2 points3 points4 points 10 years ago (0 children) | Copy Link

Do you have to be married for a set amount of time before perpetual alimony kicks in?

If you're only married for 4 years, doesn't it seem reasonable to limit the alimony to maybe 4 years? Or some percentage. Half even?

[–][deleted] 7 points8 points9 points 10 years ago (2 children) | Copy Link

Pay a woman till you retire, then be denied the ability to retire. Yeah, marriage is not for me, I'll just continue to take myself out to eat and watch movies at the theater by myself, hell, way cheaper.

[–]carchamp1 19 points20 points21 points 10 years ago (1 child) | Copy Link

Dear Men,

If you didn't already know, the purpose of marriage/divorce is to take money from you and give it to your wife. That's it. There is nothing in marriage for you, unless you're a masochist and don't feel your life to be worth anything.

Do NOT get married. This is the most important advice you will ever receive.

I'm sorry =/

[–]The_Phasers 8 points9 points10 points 10 years ago (1 child) | Copy Link

Did anyone actually read the article? The decision was overturned on appeal.

That being said, the initial decision was total BS.

[–]eaton80[S] 12 points13 points14 points 10 years ago (0 children) | Copy Link

You are absolutely right. However it seems that the Appeals court didn't make a final decision to end his alimony and discharge his over $200k in arrears. Merely sent it back to the lower court to redecide. Granted I am not informed on whether this how all appeals work.

If endless nightmare for a 72 yr old man means something, this is it.

[–]morerokk 4 points5 points6 points 10 years ago (1 child) | Copy Link

Canada has the same shit, and you can't even live together without being considered married.

[–]Strelock 0 points1 point2 points 10 years ago (0 children) | Copy Link

I just meant so the court can't collect.

[+]Arby01 -8 points-7 points-6 points 10 years ago (2 children) | Copy Link

well, I am torn.

He had a court ordered obligation that he ignored. The court reduced his alimony to $50/month - but required him to pay back the arrears at $350/month. On a 27k/year income. That's pretty harsh. But age is no excuse for not paying previously - he was well aware that he was racking up the debt along the way.

If he had paid his court ordered amount, this would be a different discussion - we have no idea how much of this was caused by his not paying when he should have/could have been. I am leaning towards 100% cause.

That being said, his alimony awards seem pretty high for someone that at retirement only has a 27k/year pension - to be given an alimony requirement of 4k/mo - that's gotta be a pretty high salary.

[–]MisterDamage 10 points11 points12 points 10 years ago (1 child) | Copy Link

that he ignored

That's not in the article. Despite the fact that he was in arrears, the court reduced his obligation to $500 which suggests to me that it was less "ignored" and more "was unable to pay". Courts don't halve your alimony obligation when you're in arrears unless the original obligation is obviously retarded.

[–]Arby01 0 points1 point2 points 10 years ago (0 children) | Copy Link

yeah, I agree, that's not only plausible but likely. However, it isn't the current courts position to rule on what happened before. Otherwise they are giving a pass to a bunch of ways to skip out on paying.

That's why I said I am torn. The guys is 72, really, how much money are you going to get out of him now? The original judgement was $1k/week - well to get 200k behind that's not paying for 4 years or only paying half for 8 - both plausible. There is really too many unknowns to even remotely conclude he got screwed, but there is enough to make it seem very possible. Or he could have a whole bunch of assets and just screwed the courts and his ex.

[+]PSMF_Canuck -10 points-9 points-8 points 10 years ago (14 children) | Copy Link

Click bait headline. The court didn't say the person couldn't retire - they said that retiring doesn't make obligations go away.

[–]MisterDamage 9 points10 points11 points 10 years ago (13 children) | Copy Link

Saying you're allowed to retire on $27,000 per year but you have a >$30,000 per year obligation to someone who declines to provide for their own support is nothing but smug bullshit.

[+]PSMF_Canuck -8 points-7 points-6 points 10 years ago (12 children) | Copy Link

Quitting doesn't absolve someone of their obligations.

That's Personal Responsibility 101.

[–]MisterDamage 12 points13 points14 points 10 years ago (0 children) | Copy Link

Marriage as a personal responsibility to provide for the support of another person in perpetuity, divorce notwithstanding. That's wonderful if you're the one who gets to have someone else do personal responsibility for them, not so great if you're the one doing personal responsibility for someone else.

[–]loddfavne 7 points8 points9 points 10 years ago (8 children) | Copy Link

So, it's every slaves repsonsibility to never quit being a slave? /s

[+]PSMF_Canuck -8 points-7 points-6 points 10 years ago (7 children) | Copy Link

Comparing his situation to that of a slave shows a complete understanding of what slavery actually is.

The gov't didn't force anything - the individual making and then breaking a commitment forced this.

It's just like business. If you break a contract - which is what marriage is - there are (and should be) consequences.

[–]eaton80[S] 3 points4 points5 points 10 years ago (3 children) | Copy Link

Alimony is awarded even when its the recipient iniating the divorce, even when said recipient is at fault of adultery. The contract analogy breaks down right there.

[–]PSMF_Canuck -5 points-4 points-3 points 10 years ago (2 children) | Copy Link

The contract analogy breaks down right there.

No, it doesn't.

Anybody who doesn't understand that should never, ever get married.

[–]muh-soggy-knee 1 point2 points3 points 10 years ago (1 child) | Copy Link

Umm... Yes, it does... You can't rely upon your own breach of contract in persuit of a remedy for that breach

[–]loddfavne 5 points6 points7 points 10 years ago (0 children) | Copy Link

It's not full slavery with the total lack of freedom to participate in society, but it ain't freedom either. If you're for instance a famous actor that's severely depressed. Being forced to work to pay alimony might actually be a death-sentance.

[–]SpawnQuixote 9 points10 points11 points 10 years ago (0 children) | Copy Link

At his age, marriage was different. Another reason why marriage is bad, they can change the laws even more and then what?

It's just really a bad contract.
