Anyone have details on details on how he "lured a minor"? Was he 18 at the time, did he know she was 15? Did she lie about her age etc? My God.. I'm so glad I went to high school before all this hysteria started, and before one night stand regret turned into rape. I was in a popular local band when I was a senior, if some of my debauchery was brought into a courtroom now I would probably be doing consecutive life sentences in this climate.

I completely agree with the above. An 18 year old contacts someone "underage", and its a predatory crime, but if they ask them in person and they start getting together, then its normal.

Here's the girl's account of the case. At one point she tells him to leave her underwear on. But afterwards she doesn't resist, because she didn't want to look nerdy by rejecting the popular boy. No really, here's a quote:

I didn't want to come off as an inexperiended little girl. I didn't want him to laugh at me. I didn't want to offend him.

She even admits that she didn't resist the encounter at all.

I wanted to not cause a conflict. I felt like I was frozen.

It isn’t illegal to engage in consensual non-penetrative sexual contact with an individual between ages 13 and 16 unless you are at least five years older than the younger person. So he could legally touch her in certain sexual ways, but he couldn't legally penetrate her.

The jury did believe that sex did occur. But, they thought it consensual. So, he got convicted basically because of her age.

I'm not a lawyer, but I think you can build a case that the charge of aggravated sexual assault was a false accusation. I tried to do that here:

That said though, as soon as the jury found that they had had intercourse, he's guilty under the law. That false accusation idea doesn't apply to the counts that he got convicted on.

But, an upshot here comes as that at the legal level, the notion of "rape culture" becomes utterly ridiculous, because how can rape get tolerated, excused, or normalized, etc. when the law condemns a person of a misdemeanor and a felony on the basis of a number, and when the two parties are close to each other in terms of maturity?

Owen Labrie basically got "entitled" to get convicted to prison as soon as the law knew about their affair, and as soon as the jury decided that they had had sex. By "entitled", I mean royally fucking screwed. And hopefully he doesn't experience such "entitlement" in prison.

He did himself in by bragging to his friends that he had sex. This is what did him in. He was definitely 18, she was 15. The gap is considered legally significant in many places (normal is 2 year age difference).

"This was a very difficult case because of Owen's own statements to his friends," defense lawyer Carney said after the trial. "I think the critical evidence was not the testimony of the complainant, it was the testimony of Owen given when he was talking to his friends and acting like a teenager who didn't want to say he had been unsuccessful in his 'Senior Salute.' "
