Re-marriage doesn’t affect CS Her income does unless she modified her income down.

So, in your case. She should be imputed on her historical income. So, begs the question- why seek a modification? She’s decreased her income from prior calculations

If she had a decent paying job and just decided to quit you could probably get the judge to impute her former income. Definitely get a lawyer for this. It’ll be worth it.

I went back and forth with her lawyer and mine for inputting minimum wage as we went to shared custody. She had rich family and they paid off her house so no desire to work

Finally when we took he to binding arbitration suddenly the day before her lawyer sends a job offer she received from her boyfriend to make min wage salary on half the hours. Fine..we went with that for this year. he whined after we were signing that it should only apply to next year. While generally she might be right she could ahev been working in the 3 years I've been out of the house so we went with it. Added a few thousand each year so we don't have to worry about it next 5 years. If she makes more we go with higher amount. In theory she could work more hours but she argued our kid has all these extra appointments regularly and she came to the number we were going to inpute anyways. We ramoed it.uo over 5 years expecting raises and increasing hours

Yeah she can't just sit at home and say she's not making any money. Both parents have a form of responsibility to provide. You also can't suddenly quit your job to purposely make less or anything

LOL, yeah… no. She’s delusional. Unless you agree to her proposal, the court should impute at least minimum wage. That was my experience.

Stop taking legal advice from your ex. She's looking out for her, not you.

You impute her income as full-time minimum wage as the floor. If she worked at a rate higher than that in the past, then you use that instead.

Im not sure I get your question. You can agree to a child support amount that would differ from the standard math problem the way the law would calculate it. Yes. Online calculators are reliable. Our state does 20% of net income for one child for example. There a few things that probably don’t apply to that changes that amount.

Yes at least a minimum wage, but should be at her historic wage level. There is even a reasonable argument that CS should even be lower due to the type of marriage she now has being able to be a SAHM. Now she has no need to earn income to support herself and the child is a beneficiary of this new life situation. She has no expenses for housing, utilities, transportation and food. Therefore there is less of a need for CS.

I’d get a lawyers opinion? Child support doesn’t get calculated by what she earns in my state it’s by what you can get paid for by your skill set.

Example. If you worked as a nurse then quit to get more support the judge would impute her and she’d have to go back.

I’m not sure but I think if she remarried it doesn’t change. They change parenting times if kids have siblings but that would lower your support. I believe? Because judges don’t really like to split up siblings.

The bottom line is moms are not the child being supported.
