Dying without a will means everything goes to your next of kin- which is your spouse. She will be your spouse legally until your divorce is finalized. So if you want to be sure she doesn’t get any of your assets if you die before the divorce is final you should do your will right away.

Be lucky you didn’t just spend $4,000 having a will done 2 years ago. Only to be going through a divorce and going to have to pay for it all to be redone. 🤦‍♂️

What's the asset value we are talking about here and what stage of the divorce are you in? Above $5M, I suggest you open a trust with your designated heir as beneficiary and transfer whatever marital property you have right away.

Marital property transferred to trust as part of estate planning process is considered legitimate use and you won't have to split with STBX, nor do you have to disclose

Below $5M a trust does not make sense financially, so you are better off waiting for divorce to be final
