Have any of you had to switch attorney’s mid-divorce because you felt they did not have your back?
After wife filed, my attorney suggested I leave the house which I did. The initial temp orders said I should continue paying all existing bills at the house as well as the mortgage. I also had to pay spousal support. Add this to the bills and rent for the apartment I had to move into and legal bills, I am starting to struggle. She also took me back to court to claim half of my annual bonus.
I have asked my attorney to go back and see if I can re-assess the temporary order. Either I’ll pay the bills or spousal support. One or the other. Right now wife does not work or says she does not. She has a side business that allows to make non declared cash.
Would the court system not expect her to work any reasonable number of hours? My attorney also appears to have agreed to mediation costs being split 2/3 for me and 1/3 to wife, plus some of her attorneys fees.
I want her to pay 50%, mainly to ensure she is motivated to resolve things, is that unreasonable?, Ultimately one of us will have to put it on credit, so why can’t she? My credit is getting impacted while she is living with no motivation to get this resolved. Also her legal fees are twice mine, since she has falsely accused me of multiple things which are untrue. With that being said, why should I have to cover any of her fees?
Am I being unreasonable or is this the way it will go?
Our relationship was abusive - I have submitted many instances of what would be considered abuse - verbal, emotional and physical. Does any of this come into play?
Personally I just want it done. We don’t have kids or much in the way of assets. Retirement and home equity. So it should really be pretty straightforward. However I don’t feel the attorneys are in any rush to get this resolved.
I have to reach out for any updates, and typically go thru the paralegal - only spoken to attorney 3 times. Twice at temp order hearings and once when he left a message about replenishing my retainer.
If this is typical, I’ll deal with it. If not I may need to start interviewing other firms.
