It's family court and they won't care.

Just file no-Fault divorce and make it go as quickly as possible. Once you have the divorce petition, then you can see if mediation will work. Of if she's going to fight you and you have to go to trial.

Ok first, let’s think about why she tried to choke you all of the sudden. She could have been trying to provoke a DV situation so she could then use the Silver Bullet strategy in your divorce. What is the Silver Bullet Strategy? They will claim you abuse them or the children to put you out of the house and prevent you from seeing your children for up to a year. Then file for divorce and say he hasn’t lived in the house nor seen his children and ask the judge to grant them both the house and full custody because, status quo. Additionally being charged with DV via protection order or criminal charges will greatly impact your ability to stay employed of find new employment. And the more times they make these claims the more money you have to spend to defend yourself. So the strategy effectively takes your house, kids, job and ability to defend yourself away while draining you financially.

Abuse against men isn’t taken serious in family court. You will find very little to no relief there. Energy is better out in moving on in life and trying to distance yourself from said person.

What are you trying to accomplish? If you’re looking to go to court to get ‘justice’ or ‘the truth out there,’ yeah I would say you’re wasting your time. The purpose of a divorce court is to deal with children and division of assets. That evidence might be useful for those discussions. But if not then just do a quick divorce and be on your way. Healing from being in an abusive relationship isn’t for divorce court. If there is likelihood for it to continue into the future then yeah of course. You need a protective order. But buddy court really isn’t what you think it is.

It is still “no fault” divorce, that just means that one doesn’t need to prove that the marriage is broken and irreconcilable to get the judge to issue the divorce. You will almost always do better if you can avoid hiring an attorney and fighting it out. You are not going to have a judge have you pay less just because she choked you. She is a woman and that is just going to be brushed under the rug. If you make a big deal about it you will later regret it because it will only put her in fight mode and you will spend a fortune on attorneys. If you get an attorney he will love to hear that because it means a messy divorce which means more money for him or her.

As you mentioned, Texas is no fault. Forget about getting any leverage for her cheating. The only thing you can hope for is that she wants to be with the new guy and just agrees to give you what you want. Get the divorce rolling quickly.

My ex gave me the house, but after they broke up, she constantly talked about how unfair the settlement was. I posted about this, but its been 7 years, and i'm putting house on the market. She had the balls to ask how much she was getting from the home sale. GTFOH. I busted my ass to keep the house so the kids could stay in a familiar place. Unfortunately for her, the value went up starting in 2021.

On the choking thing, if you did not file a police report, take pictures, etc....you can likely forget that also. Good luck man. Go talk to an attorney immediately.

Not worth it. It won't help your civil divorce case since it is no fault and probably wouldn't have any bearing on asset division. However if you think she may have hid massive amounts of money and there are messages related to hiding that money, okay then maybe.

As a cop and as someone who has got social media data using search warrants, often they don't maintain that data for too long. When I'm seeking that data I send a preservation letter immediately and then follow up with court process. If you're looking for messages weeks or months ago, it may or is probably not there anymore.

The courts don’t seem to care

What’s important to you is rarely important in law system.

The blame game just costs money, time and headspace.

Vent to therapist it’s way cheaper. Imho
