Judges tend to go with the GAL report recommendations - GAL is essentially a court officer and has spent dozens of hours interviewing you, the kids, family, doctors, schools, etc. The judge isn't going to get that amount of time with your case.

Go over your testimony with your lawyer. Be ready for your ex's lawyer to try to push your buttons or to get you angry. Be calm and remember that you're not going to win an argument with them, and being angry counts against you in the judge's eyes.

Then, get your checkbook ready, because this isn't going to be cheap.

Where will she come up with the trial retainer her lawyer should demand?

You said in a prior post that she hasn't discussed other settlement matters. Clearly she's in a disagreement about custody but the fact that she's not left the marital home suggests she intends on staying there. That said, reasons for court could be the house, the car, debt, alomony.

If your kids are barely speaking to you it's likely they're hearing a lot of "daddy's making me live in the basement", and many other things to ensure their "loyalty" to her. It's a for of parental alienation and you should contact the GAL about this occurring since knowledge of her recommendation. Would heavily suggest recording attempted interactions, avoid any conflict at all with her and in front of the children. And understand that you've just as much right now to take the children for activities and meaningful time as she does. Sitting them down and tell them that despite their mother and you not being able to work out indifferences that it has nothing to do with them and you still love them the same. Seeing their mother in a basement and crying can be very impacted to children. And if you haven't already I'd also suggest getting them in to a good family counselor to work through their feelings if old enough. This can also be food documentation from a professional should she attempt to sway them to lie for her. As most states move to 50/50 I'd like to say don't worry but spiteful people have a way of causing havoc.

May I ask what she thinks she stands to gain by going to court? Is there a dispute regarding custody?
