I think here in Philippines, whoever have the more money and can give better welfare to the child has the rights to the kids and of course, if the other party is in the wrong ie, cheating or crime, that party won't have the rights and might also be banned from seeing the kids until they turn 18.

Edit: I have lots of male cousins who're in divorce and they have the custody of their child since they're wealthier and/or isn't the one cheating.

The Legal system is pretty fucked but this implies that a woman who makes very little money but loves her kids should have to give up custody. Back in the day-day ulit was automatically the mother.

Now all states disregard gender and leave it to the parents to decide. Most of the time BOTH the mother and father agree that the child/children would be more fit to be with the mother especially in their tender years.

If both parents want custody then the child (or each child) if within a certain age can decide who they want to go with. most the time they really cant decide so all parties agree on a joint custody or partial custody.

To be fair, here, women aren’t granted child support necessarily because they can’t afford to raise the kids without his money. The court makes any non-custodial parent pay child support because both parent should be contributing.
