This makes perfect sense if you subscribe to the notion that men who do bad things are bad people, but women who do bad things are victims of the patriarchy.

I do not subscribe to that notion, but those who do are essentially denying that women have agency. Fair enough: but there's a word for people who don't legally have agency: we call them children, and we don't let them do things like sign contracts, vote, initiate lawsuits, run for office, or have custody of minor children.
