I was listening to Mike and Mike on ESPN Radio on the way to work this morning and they were discussing this incident. They kept receiving emails from viewers saying "the girl swung first" or "if she was a guy this wouldn't be and issue" and the hosts of the show completely wrote those comments off as bullshit. It seems that the media is completely out of touch with the view of the general public.

I don't understand this. At common law that woman committed assault and battery. She 1) created the reasonable apprehension or fear of an imminent battery; and 2) applied an unlawful application of force.

She also committed tortious assault and battery by 1) creation of a reasonable apprehension of an imminent battery; and 2) applied a harmful or offensive touching. These are dignitary torts and damages, I believe, are presumed.

If that guy was a cop he would have body-slammed her into the dirt. Why is he being expelled and arrested? I believe he can maintain a self-defense argument and, at least civilly, seek damages for her tortious conduct.

This is fucking pathetic. She punched him in the face then he hit her back, so it was clearly self defense. The article downplays everything she does and exaggerates his actions, making him look like the bad guy, just like how these things always play out.

As a man, there is apparently no such thing as self defense from a woman. Hes going to suffer the wrath of a media shitstorm which might cost him his professional career, and shes gonna get a fat paycheck for starting a fight then pulling the victim card. Remind me again how women are institutionally disavantaged?

At the risk of venturing into conspiracy territory, I have a hypothesis about this. The main reason this is such huge news is because of Winston. This guy is only a fourth string QB on the team, he is not some celebrity or anything, but the news is being plastered all over because the media wants to "correct" the perceived shortcomings of not being able to destroy Jameis Winston, a QB from the same team. Consequently, this is all over the sports news. If it had been some random guy in a bar, it would have been a footnote on feminist blogs.

She also allegedly used a racial slur. Imagine this were two men instead of a man and a woman. Nobody would be defending the white guy who got angry that a black guy nudged him, and then the white guy went on to call him a racial slur and assault him.

I don't see how feminists get to complain about society treating them as weak and in need of protecting, and then go on to say, "Men should NEVER hit a woman EVER!". You can't have it both ways.

Im advocating for no violence at all. For me both of them where dickheads. But what makes me rage is the completely biased reporting on this issue and the fact that noone would bat an eye if the "victim" in this case would habe been a man. Because women are delikate flowers AMD patriarchy an shit.

He initiated the contact. She beat him to the spot and then he elbowed her in the back to get past her. Then she turns and they start to grapple. He has complete control over her. She resists, get's one arm free, swings at him and misses badly. Then he unloads on her. Is he guilty of a battery? Nope. Is he guilty of exercising poor judgment? Yup! As a high profile participant in a very high profile multimillion dollar entrainment enterprise may such poor judgment effect his ability to continue to perform? Yup.

One is only allowed to defend themselves if they have a reasonable belief that they are in danger. So the issue is whether or not his response to the threat was appropriate. For example, he did not have the right to shoot her with a gun. Also, what if it was a five year old that swung at him, would it be ok for him to deck the five year old? Of course not. Will they be able to convict him here? Nope. Did he have any reasonable fear? I doubt it, but that would be impossible to disprove.

He was terminated from the team for causing a distraction by getting into a fight at a bar. Too severe? I think so. But I also don't know what else was going on with him and the team either. Was he a hot head at practice? Was he under performing and they wanted to get rid of him and this was an excuse? I have no idea.
