Most false accusers never go to the police.

This kind of legislation is definitely a step in the right direction.

But I think we need to focus on the social aspect of a false allegation by buffering laws around slander and character defamation.

The legal system already gives people a (relatively) fair opportunity to defend themselves. The real damage happens outside of the legal system though. For example, many men find themselves unemployable even after being found innocent by a jury of their peers.

Just look at what Johnny Depp had to go through, and is still going through. Even after a civil case siding in his favor. And he has money and fame to fall back on. Which is a lot more than most victims of false allegations have.

Making a false accusation about any criminal activity should be treated as a contempt of court and perjury and punished: sexual offences do not require special treatment.

The problem at the moment is that punishment is left up to the judges discretion which can introduce bias, so there should be defined mandatory punishments to dissuade that practice.

Also, I think it is time that accusers be treated the same as the accused in being required to tell the truth, the whole truth and nothing but the truth, under penalty: accusers need to be just as much scrutinised as the accused because we should be seeking justice for both accuser and accused.

Sexual offences accusations are much more damaging to the accused's life than any other crime. They damn well do deserve their own criminal offence title and punishment. If convicted, the guilty party is subject to much worse punishment than say battery. If the accusations are proven false, the false accuser deserves the punishment that would have befallen the accused.

If rape and sexual assault were treated the same way as any other assault, fine... But they're not.

Now, using that same logic, what would it be like if the accused were actually guilty? Do you seriously believe it’s appropriate to treat a victim of sexual assault like a criminal simply because the evidence weren’t strong enough? Because that’s basically what could end up happening.

I like the way crimes are rated currently, you have a given severity with a sentence reccommended, and then add and subtract various modifiers. Problem is that those modifiers are too generous in crimes that don't result in a 10 year sentence, and then the actual crime being prosecuted can vary so much in a final sentence based on the discretion of the prosecution. Eg, murder of various degrees, manslaughter etc.
Often dropping down a level of severity is excused because it makes it more likely to get a conviction, but it can also make a mockery of any sentence given.
I don't think we need a new crime of false accusation of a sexual offence, that would take new laws to be passed which is a very cumbersome and lengthy process. What we could do is link this to a very severe form of perjury where the starting tariff is several years in prison. I'm not familiar with the process for this, but I can't imagine it would take anywhere near as long as creating new laws.

This is the classic slippery slope. So you throw the book at false accusations. OK. But what about the close to 30%(depends on where you get your stats) of all accusations where there is not enough evidence to prosecute? These women more than likely have been raped, there just isn't enough hard evidence to convict. You are opening the book to rapists who didn't leave enough evidence now getting their victims also thrown in jail. I'm all for throwing the book at vindictive partners who try to use the legal system to punish former lovers. I just don't think there is any way to write this law without sending rape victims to jail as well.

By “report” does it mean organizations forwarding on accusations?

Here, the news (or anyone else theoretically) can’t release the name, photo, or other identifying information of a minor accused of a crime or arrested. Mirroring that for adults accused of sexual crimes might help. Keeping it off police records unless convicted should prevent it coming up on employer background checks.

I don’t think you want to go after the person making a false accusation because it would disincentive them fessing up which is how many guys get cleared.

In my opinion if the only evidence is he says / she says, the defense should be able to file for dismissal and get it granted easily for lack of evidence. Sucks, but one of the founding principles in the US (and UK i believe) is that it’s better to let guilty go unpunished than to punish the innocent.

The way the system works in US, you're innocent till proven guilty. In countries like UK, with the way their laws work, the burden of proof lies on the accused so its the opposite.

No you're completely wrong, they're different. You probably haven't even lived in any of these countries nor are you a legal expert, clearly.

Where I am in BC common law marriage is only 6 months, but any wealth accumulated before the relationship started doesn't count when there is a separation. Also, audio and video evidence is accepted in court (most places it isn't in these cases) but false accusations still happen all the time.

The funny thing is it happens to women now too here, cus the courts are suppose to side with the woman but with the whole "trans movement" happening, a guy can just say he's a woman and the courts can't discriminate because of bill C-16.

We got other problems though, like children getting gender transitioned against their parents wishes.

(Kids cant get a tattoo without a parents permission but if they want to have their genitals butchered, or take hormones that permanently destroy their reproductive system, then that's fine apparently but that's what you feminists are fighting for so I know that wont matter to you....)

They also took away our option for private healthcare.

(Sounds good on paper, they were claiming it would lower wait times for the free health care, yet they keep flooding the country with immigrants that despise the west and should have no right being here, while denying people who actually wana come, so the wait times have only gotten worse since they removed the option.

It also made dental insurance harder to come by because a lot of employers would only offer dental care cus it was apart of their healthcare plan, so it costs twice as much here as it does in the US because dentists don't have as many insurance companies to make money off of, leaving everyone paying more...)

On the surface this makes sense but there are flaws.

Not all legitimate allegations end up as successful convictions. If making false allegations were to be criminalised, women (or men) who were genuinely raped might end up with a criminal record for reporting the crime if their case proved unsuccessful. Whether that be down to insufficient evidence or whatever.

Obviously, if someone has actually been raped then she should be able to report it without being worried about going to prison.

The issue is that there are too many women (or men) out there who would happily take advantage of this. Knowingly falsely accusing someone of rape is as bad, if not, worse than rape itself. You're willingly destroying someone's life, ruining every friendship/relationship that person has ever made and making it so that they'll never be able to get a decent job again.

I think the middle ground would be to provide defendants with anonymity until conviction and in the cases where it has been proven that accuser has made the allegation up, as opposed to there just not being sufficient evidence (however that might be proved), give them a mandatory 5 year sentence and plaster their name everywhere.

No, not proving a rape is not the same as proving a false allegation. A proof for a false allegation would remain needing to be beyond a reasonable doubt.

And the very same basic premise you're using comes up when people get convicted of crimes they didn't commit, in every single possible combination of crime and charge. And make no mistake, the system is flawed and massively over worked, it's wrongful conviction rates are only getting higher. So should we just get rid of all possible charges?

Exactly. Prosecutions would only be possible when there is actual evidence that a person knowingly made a false accusation (confession, CCTV, etc.). This would not put genuine assault victims at risk.

Not true at all. Mistaken identification by eye witnesses is a huge issue in false convictions. Just look at some of the innocence project's files.

This is a very good start and it gives justice for the innocent men.

However... the non-legal consequences can be more damaging, and it's past time as a society for us to deal with that. Maybe legally as well.
