You say she's now filing for CS, what were you paying before? I sure as fuck hope you weren't paying something that was not court ordered.

The child support scam is a nightmare. They have a great deal of power that can be brought to bear on you. In my state, child support collection is a money making racket due to the Title IV D rules. They are given money from the federal government based on how much child support they make someone pay. And men pay the great majority of child support since women are given primary custody the majority of the time. In this area, the child support office has their own assistant DA just for child support cases. Start learning all you can so you can protect yourself.

She may be fucking herself over? If you are not employed then CS may be lower now. Also, if you have been consistently supporting kids and her then it counts as CS. Hopefully you payed e transfer or have paper trail. Some banking apps allow you to edit e transfers as child support after you have paid it. If you can print off all the payments. Since you are not working, you may be eligible for legal aid lawyer.

Lesson to be learned. She is emotional and destructive. Hopefully you dont have to deal with alimony BS.

I was about to say this is a confusing post. But I see where you updated it to say you weren't ORDERED to pay before. The good news is that, generally, child support can only be ordered to start when she files. And if she files now, when your income is so low, that works to your advantage. However, be aware, she (or her lawyer) will argue that your income should be IMPUTED. That is, if you earned $100k last year, they'll argue you're CAPABLE of earning that much, and that's the number they'll want to use in the calculations. Expect this. And be ready to fight that claim.

her asking for my driver's license

I'm pretty sure I know what's going on. She went down to the child support agency, and they gave her an "in-take" form for new clients. The form asks for EVERYTHING about you. For sure, the form asks for all of your financials as well as your bank accounts, SSN, DOB, passport number, driver's license number, and so on. They assume you'll be a deadbeat dad sooner or later, and when that happens, they want to revoke your passport and driver's license. Because they're lazy bureaucrats, they want her (and in turn, you) to provide them with the ID numbers. It makes their job easier in the future.

And to that, I say 'fuck you'. You're under no obligation to help the child support agency develop a case against you. Make them go find your driver's license number if they want it. As the saying goes, anything you say can be used against you. Personally, I think the child support agency is the enemy, and they put you in an adversarial position. So, why help your enemy during war? Why answer their questions? Perhaps it's premature to whip out the Constitution, but you do have a Fifth Amendment right to refuse to answer questions. Believe me, I've used it. I refuse to answer their long list of irrelevant questions.

I understand they need income statements, but they'll ask for your boss's name, his phone number, his address, your cell phone number, your e-mail, sometimes they even ask for your social media. They want you to lift your skirt. On my ex's in-take form, they wanted to know if I got to keep the airlines miles I earned while traveling for business; they wanted to know if any meals were catered; they wanted to know if I got free coffee at work. Because, hey, if a cup of coffee costs a buck, I owe my ex 33 cents every time I got a mug of Joe. Seriously, they want to know every detail.

Sorry, long rant. Maybe I'm bitter and jaded, so perhaps don't take me too seriously. But it's my experience that the child support agency and your ex-wife are conspiring to hurt you.

I totally fucked up and I know it. I've never been divorced before and I wasn't thinking straight. Long story short, we agreed on what she needs financially for the kids before I moved out. So I did pay her monthly with out it being court ordered. Now she's upset and thinks I have income coming it. So now she's filing for CS today.

Just make sure you state your income as 0 and you are unemployed, part time Uber driver does not qualify as employment. Secondly, do not provide her any document, in fact even if the court asks you, make sure the only thing given is your termination letter. Flatly deny you made any payment to her earlier

I believe you are in a good position now, CS will be bare minimum and no one usually monitors if you are employed later

Sorry for all that.. and it really does scare me how easy any of us can be in that. Truth be told.. I am literally NOT filing due to owing about 60K in debt right now and not able to afford move out costs and lawyer costs. So.. until I can do that.. I am stuck. Worried about my job too.

Question.. how much is your unemployment? I assume you were in the 100K+ salary range, so you should get maximum benefits? I thought I read that 600 a week (before taxes) is the max payout regardless if you make 30K or 3mil a year. So with potentially 2400 a month pre-tax.. how are you able to afford living at all.. rent alone unless you are in a shack in the mid west has got to be 1500+ give or take. Food/car/internet/phone/etc adds an easy 1000+ to that..
