So, I'm currently living in North Carolina and here, you have to wait for a year before filing for a divorce. I guess it's to give you time to reflect and potentially have a change of heart. However, things aren't going too well with my split (surprise, surprise).

My concern now is that we had an agreement where I would give her money bi-weekly for our kids, but she's now claiming that everything is hers and that I won't receive anything once the divorce is finalized. This is making me uneasy.

A friend of mine suggested that I go to probate court and file for child support so that my payments can be recorded. His fear is that if my soon-to-be-ex-wife decides to be nasty about it, she could claim that she hasn't received any payments from me. Or worse, the court may not recognize our previous agreement and require me to pay back child support.
