I would say no, but my definition of rape requires force or coercion. No force, no rape. I think the obsession with verbal consent is insane. It implies that people are completely aware of what they want and never change they're mind or do things they're uncertain of. If you had sex with someone and all you had to do to avoid it was to say no or walk away you weren't raped IMO.

It would entirely depend on what you mean by:

What does this mean? Did she have sex with him? Did she say no and just lie there impassively? Did she grab his cock, slap it inside her and ride him like a rodeo?

Enjoying sex and feeling physical desire are irrelevant to consent. The only thing that matters is whether she consented. She doesnt need to SAY she consented, but she needs to consent through her words OR actions.

In law if the other person doesn't consent it is sexual assault, whether or not in some more abstract sense the person wants it to happen. They have to consent to the specific act.

OP, are you asking "legally, is this rape?" or "is this rape according to your own thoughts on what 'rape' means?"

If the question is the former I can't answer - I'm not a lawyer and I don't know where this interaction is taking place. If the question is the latter I'm going to agree with someone below and say that this:

Is it rape? Maybe, maybe not, who knows... honestly, it's not that big of a deal either way. Unless you popped her cherry and then pull a cad maneuver and disappear into the night, you're pretty much morally in the clear. If "guy pushes on" isn't coercive, then no. But this is a super vague situation. Consent does not have to be verbal, but there should be some form of consent from both partners. If she "wanted to have sex with him anyway", and she "thoroughly enjoyed it" then she'll act like she wanted to have sex and she thoroughly enjoyed it. It might have been a bad choice, but that doesn't make it rape, just a bad choice.

How is this even a question? If she says "no" with her mouth, and you keep on, that's sexual assault, and escalation to penetration is rape. If she says "no" with her body (certainly mutes must be able to signal consent), and you continue on, it's rape.

In the extreme hypothetical where she says absolutely nothing, and gives absolutely no physical indication of consent or rejection (i.e. acts like a rag-doll)... unless you are role-playing some kind of agreed-on fantasy, you are creepy as fuck, she's fucking damaged, and while there's no crime... you deserve whatever repercussions happen.
