As someone who has a friend who was raped and the guys got away with it, on some level I wish it would have been easier to expel them so they would be gone and she wouldn't have had to transfer to feel safe again.
However, I can't let my feelings about my friend's case get in the way here. We can't just go around and lower the standard to make it easier to completely tarnish the record of an innocent person. I get that more guilty individuals would be punished, but is it worth it if we also drag in those who may have been wrongly accused?
Instead our schools need to take this issue very seriously and try to prevent it from happening in the first place. And when it does happen, a full investigation needs to take place to determine the facts (instead of the school trying to cover their asses and protect the guys who happened to be star basketball players like they did at our school)

I do agree with you. The police are much more capable of performing an investigation, and they should ultimately be the ones that do so. In reality, it's much more frustrating because rape cases are often very hard to indict and convict due to a lack of evidence. In the case I'm referring to, through school hearings, a level of guilt was found so the accused received some minor punishment but were not expelled.
Without solid evidence, of course, a conviction should not occur. That's how our legal system works. Just frustrating to know what actually happened in this case despite the lack of physical evidence.

Partially true (at least from what I've heard...so take that as you will). It does seem likely that most rape cases are of the "too drunk to consent" type (college parties do lend themselves to that kind of setup). However, I have heard of a good number of forcible rape or rape by intimidation cases (regardless of whether alcohol was involved). However it could be the case that many of those too drunk to consent cases were brought on by spiking drinks/other methods. We just may never know - not sure if the research is out there about that.
Regardless, I think it is important not to jump to any conclusion (in support of the victim or the accused) when an accusation is made. Too often do people automatically blame the alleged rapists for their actions or accuse the victims of making it up or putting themselves in that situation.
