As someone who has a friend who was raped and the guys got away with it, on some level I wish it would have been easier to expel them so they would be gone and she wouldn't have had to transfer to feel safe again.

However, I can't let my feelings about my friend's case get in the way here. We can't just go around and lower the standard to make it easier to completely tarnish the record of an innocent person. I get that more guilty individuals would be punished, but is it worth it if we also drag in those who may have been wrongly accused?

Instead our schools need to take this issue very seriously and try to prevent it from happening in the first place. And when it does happen, a full investigation needs to take place to determine the facts (instead of the school trying to cover their asses and protect the guys who happened to be star basketball players like they did at our school)

I wonder if schools are partially doing this to cover their asses from lawsuits. If they go with the "reasonable doubt" standard and are wrong, they are left open to hordes of lawsuits from batallions of helicopter parents who believe the school's bad judgement put their little princesses in danger.

My guess is that is what English was suggesting with her bizarre comment, that and the fact that the "Dear Colleague" letter is ostensibly designed to prevent discrimination (it is based on a misapplication of the law, as former Department of Education attorney Hans Bader has demonstrated).

I still don't get it. Discrimination of what against whom? Was there some context to the quote that might shine some light on what she meant?

I think someone should accuse this miss English of rape or sexual assault. If its a student accusing her they should use this new lower standard of proof to fire her and prevent her from ever getting another position in any university.

Is she suggesting that the supposed victim was only raped because she was a girl? Well, I guess she probably was raped because she was a girl, but I mean, that's because the supposed rapist is heterosexual...
