If you and your soon-to-be are both represented by separate attorneys when drawing up and signing, a prenup is almost always honored. In other words... don't write it yourself.

What causes judges to toss them is when they are ridiculously one sided or signed without advice and representation from an attorney. Go see a good attorney and they will let you know what can and cannot be covered in a prenup and what should be considered fair. Then have your fiancé find their own attorney to review and advise.

I heard an episode of Tom Leykis where they had a guest lawyer on to discuss prenups. His best advice was to hire a videographer to film the signing of the prenup. You then have her on tape being asked by both her and your lawyer that she understands the legal ramifications and is not signing under duress. He said that it would be almost impossible to overturn that with the usual claim of “she felt pressured “.

Saying that, I still don’t think any man should be getting married at all. I certainly won’t.

Get a good lawyer, it's worth it. If you are wrong about this new woman, the divorce will destroy you. Make sure your prenuptial is iron clad and favors you.

How enforceable varies from state to state, how written, time of marriage, etc. There is nothing that's 100%. Prenups get thrown out, normally for coercion or distress. This can include her saying 'he said he wouldn't marry me without a prenup.' That's coercion!! You need to talk to a lawyer, she needs her own legal representation, both parties need witness, video, etc. etc. to make these things work. AND EVEN THEN, the law can change and just hose you all over again.

As other mentioned what's the purpose of the legal contract with the government (ie marriage) vs a LTR with all shared accounts / residency / DPOA / etc?? The contract ONLY protects the female (hence why you are looking for a prenup).

I've lived in the UK and the USA and I k ow they can work I've heard from lawyers who claim they can but personally I've never experienced that and I've never actually heard from anybody who had one that it worked.

You get married if you want, speak to your lawyer and get their advice on the prenup, your lawyer will tell you how likely it is to work in your area, as that's what law gets applied to it.

Your two options are a prenup or a irrevocable trust. Irrevocable trusts cost more and are more restrictive but also prevent courts from getting any ideas. But a prenup might still be upheld given the precedent in a jurisdiction. Even if the lower court does something stupid, you could appeal to a more sensible appellate court.

If you have kids after signing the prenup, that can cause problems. And if she doesn't have independent representation, that's also a problem. Otherwise they tend to work if done correctly.

You don’t need to be married in 2022. You can buy a house and have kids out of wedlock. I doubt I will get married again. It just makes stuff more legally confusing
