I wouldn't have accepted NJP. I would have plead not guilty and gotten court martialed. That way I could've defended myself.

For those not in the military, NJP stands for Non-Judicial Punishment. It's a way to be punished for messing up with taking a lighter sentence, as you don't need to involve the NCIS or other branches' equivalent.

BUT,

The only reason why it happens like that is the service member being punished plead guilty. They admit they did what they are accused of. For something petty like this, (disorderly conduct is a misdemeanor in most states,) you will heavily be encouraged to go through NJP because otherwise you'll waste resources and get punished more harshly and may even receive a dishonorable discharge (which they cannot give you with NJP.)

From my personal experience though, they are less likely to court martial someone the lower the crime is because there just isn't enough decisive evidence.

So yes, to all service members, try to keep cool when being yelled at by the people pushing for NJP and request to talk to a Jag first before making your decision. The people who are pushing for NJP might even say that talking to a Jag will automatically make it a court-martial, but that is not true.

Edited to add: I showed this post to one of my Navy buddies and he pointed out that if you're actually underway, you can still be masted even against your will. The exact wording is "attached to or embarked on a vessel."

However Subsection E of Article 15 of the UCMJ states that if you suffer a reduction in rank, or are punished for more than 14 days, You can appeal the decision of NJP to an authority higher than your CO, and they must involve a JAG on your behalf to decide if you have committed the crime, and the punishment you have received is just for the crime that you have committed.

I am not a JAG so I don't know the exact ins and outs of this particular appeal process. I only want to arm service members with their rights. If you are unsure about anything, contact a JAG, they can help answer questions for you.

When I was in, I had just gotten to my first training command outside of boot, and there was a bunch of people who came and gave us a bunch of talks including the chaplain, some of the higher level teachers, the SAPR, and a JAG who worked in our school building who said that if you had questions you could stop by his office and ask them as long as his door was open, and I went up to him and asked him for a full copy of the UCMJ so I could read it so I can understand my rights, because at the time I was an 18-year-old dating a 16-year-old girl at home and I was wondering whether or not it is against the UCMJ like everyone was saying.

For situations like this men need to be taught to hit women back. And file complaints to the club, to the police and whoever. Otherwise it will continue like this. Because men are used to getting used and abused with no justice, especially by women, they are demoralised and dont fight back. But you need to learn to change that.

Or better yet, dont go to places that revolve around alcohol, especially women. No good will come of it, those women are not worth your time.

Look up DSM V criteria to handle the leading questions. They are looking for medical retribution and want to give you a diagnosis.

Stay out of bars and stay away from people who are drunk. Avoid situations in which people act like complete fools and venues in which such drunken toxicity thrives. Focus on your education, career and improving your life. Use good judgement. It's bad judgement to be drunk and it's bad judgement to be around others who are drunk.

Drinking alcohol is bad. Being around drunk people is bad. Bad judgement is bad.

I'm not blaming the victim. Getting drunk and being around drunk people VERY OFTEN leads to bad situations. The more often you associate with said environs, the more negative life problems you're going to experience. By simply avoiding such situations, you'll save yourself a lot of pain and heartache. Instead, pursue healthy, life improving pastimes.

Bars exist as social lubricants to get adults to drunk-fuck so babies are produced. Lots of child support financial enslavement sentences originate from one night stands following post-bar drunken escapades. It's a trap. Traps are bad.

I have a really cool wife and I swear for more than she looks up to me to 'protect us' or make her feel safe---that woman protects me and makes me so much safer, just in 'these' situations, interactions with cops, and whatnot..

Hell I can relate to your story even more after my ex who was also violent and after one sided situations she called and lied to cops and had me arrested. I still do custody swaps with her and have to see her, my wife is my hero though and is always trying to be my witness and be my voice (and if a woman put hands on me my wife would end that shit fast so I wouldn't have to).

I'm not mad in that I seriously appreciate her and this, because I understand the world is as it is.

But the world sure seems fucked up and bass ackwards sometimes...

i dont understand the logic, yes a solider/ military is a trained weapon and thus you are judged harshly anyways by default but by common law everyone has a right to defend themselves. if that creature had a weapon or keys in her hand as she was punching him she could have caused life changing injuries to you.

the bars are owned by women now and the clubs, just avoid those places now. go out to where they dont exist like hiking trails, mountains, forests, hills. they are making as go back to our masculine roots and they are more enjoyable anyways. fuck her and the system.

Sadly, one of the first lessons men and boys learn about the law and law enforcement, is that being male is the only evidence most police need to arrest and charge you with offenses against women.

If you are male, always remember, the police are not your friend, they are not concerned for your safety or your legal/human rights, and are most often more likely to arrest and charge you with a crime, regardless of your guilt or innocence.

If you are stopped by the police, only ever give them the information you are compelled to give them by law (different by jurisdiction, but usually includes identity, address and what you are doing, Never voluntarily give them any other information or co-operate in any way, never believe a word they say, and never ever believe they are trying to help you. They will try every trick in book to get you to speak to them, but you would be a fool to do so.

Idk your situation but if you're Navy I would advise talking to a JAG and denying Captains Mast/NJP. You have the right to push it to a court martial trial over NJP in times of peace/non-actively deployed. The tough news to hear is that there's a solid chance they ADSEP you just to avoid the hassle. Again I would go talk with Legal first chance you get. Sorry if this is too late.
