Yes she can, so move 50% to your account. Do what you have to do to prevent defaults. Not sure if you can, but see if you can set the account to deposit only, with ability to still pay the running payments, like mortgage. I had to do this with the home secured line of credit.

I'm not a lawyer but in my experience with my divorce she certainly could take out at least half and probably would not get in trouble with the judge. She could probably take more if it's too pay for legal fees. It really depends. As part of discovery, your lawyer will request all her statements so you can see where the money goes.

If you're concerned about this, consider talking to her and agreeing to each take out half only if each person going forward will deposit a specific equal amount to pay a specific set of joint bills you both agree on.

Change your direct deposit to go in to a personal checking account for yourself. She would change hers.

Or if you don't like that idea tell her you want her to wait to see what the judge says. Do it over text or email.

If she is a stay at home mom, deposit your paychecks into a new account only you access. Keep the bills paid up. Transfer some amount to the joint account every month or bi monthly.

The goal is to not let her siphon off funds while also not pissing off the judge by cutting her off completely, all while keeping your bills paid.

If she works, do the same thing thing without the bi monthly transfers and somehow get her to pay for household bills. “I’m paying the mortgage but none of the other bills.” Then don’t pay them.

Basically keep as much of your income as possible while still keeping the status quo.

There's a tool that you can track all expenses in the last 24 months. If she made any purchases that are considered wasteful dissipation of marital assets, you can get credits back in your settlement.

Your not divorced yet, thus it is still her as well. She could go buy a car. You would be entitled to half the depreciated asset. Move some to an account you control. She will still get half, but it will be safe from being spent in the mean time.

She can. My wife cleaned out out joint accounts and moved my stock portfolio into her social only. If it’s joint, they can drain it to ZERO with no repercussions.

When they file, that’s when the “snapshot” happens.
