Federal law says she can’t take the kid out of the country without your consent. Don’t consent and boom you have custody.

I’m going to add that any paperwork regarding your child, birth certificates, passports, etc should be sequestered away from her in case she tries to bolt with your child.

Get a protective order, tell your lawyer that you don't authorize the relocation of the kid, ask on what to do if you suspect that she is taking the kids away.

How come she didn’t get her permanent green card during the 7 years of marriage? Did she come here within the last two years? You can try to wait until she gets her permanent green card or she can find a way to get a green card after the divorce which may be tough.

If you do get custody don’t plan on getting any child support from her if she has to leave the country because it probably won’t be enforceable.

More info is needed. What visa is she on? H4? Did you sign the affidavit of support to bring her on a visa? As suggested both of you are better off working out a deal where you are legally separated but still married with zero alimony and zero CS and 50:50 custody as a condition

You will NOT get alimony. You make more than her. Child support depends on the custody decisions.

Best thing you can do is make a deal with your wife. Leave the courts out of it for the sake of the welfare of your child.

Divorcing someone in an attempt to force them to leave the country will not be viewed lightly…and frankly, don’t be that fucking asshole.

Your child needs both parents.
