Damn she joined the Military at 36? Something to consider is that if you two are still married and she’s cheating on you it’s punishable by the uniform code of military justice. So that being said it’s fairly serious, the punishment could potentially be a dishonorable discharge or even confinement. Those may be on the more serious end of punishment but still I’d probably consider that potential.

My guess is that you are going to have to defend your case to the best of abilities in the court. You can say that you want an environment of good behaviors and disciplines to upbring your daughter and that you have evidence that your wife is not fit for that. But the chances are that the judge may say that what ever your x does at the movie theaters belong to her private life and as long as she doesn't bring that to home your daughter would be fine.

If you are fighting for you child, you are not being petty.

But make sure you do that and not just reacting on your jealousy or whatever other feelings you might have.

Don't bring it up as just your words. Either you have proof or it never happened.

You’d need some sort of proof even if you just went to her CoC. Without that, her division officer, or whatever it is in your service, will know exactly what you’re doing and will stick up for his soldier/sailor/Marine.

Places in town that are restricted to base personnel are tough to enforce without an MP sitting in the parking lot at all times.

If she’s doing this kind of shit, I’d be willing to bet that she’ll fuck something else up before too long that’ll be worthy of some sort of NJP. I had to take a bunch of sailors to Captain’s Mast back in the day. I can see a pattern here.
