The difficulty of defining incapacitation and consent was underscored last week when Dean Wasilolek took the stand. Rachel B. Hitch, a Raleigh attorney representing McLeod, asked Wasiolek what would happen if two students got drunk to the point of incapacity, and then had sex.

"They have raped each other and are subject to explusion?" Hitch asked.

"Assuming it is a male and female, it is the responsibility in the case of the male to gain consent before proceeding with sex," said Wasiolek.

This is the Dean of a major university explicitly saying that obligations to gain consent are unequal. Where are the feminists protesting that?

Show me any jurisdiction that says that. Please, I implore you to show me legislation from any jurisdiction that says anything along the lines that drunk sex is rape of the female party. This is rhetorical, BTW, because the law does not reflect your and other MRA/RP understanding of it. The law, in the case of intoxication and sex is referring to instances of one party being so intoxicated that they are incapacitated. They are unresponsive. We are not talking about tipsy sex, here, which is what terps and MRA refer to when they put their outrage pants on, so stop.

It's not rape. If a woman chose to get herself drunk to the point where she is unable to consent it's her own fault. The same is true for the man. It's a stupid thing to do, but not rape unless she was forced to drink against her will (like tied up and forced to chug) with intent to rape her, but I think that's a different crime altogether.

I disagree; neither party raped the other. I think that putting the "blame" on the person capable of penetration contributes to the notion that women are passive receivers in sex, not capable of initiating, contributing or participating.

I do think, since you clearly want to discuss drunk sex vs. rape, that there are many nuances to consider.

I like to bring up this analogy: If my cousin got me shit-faced in order to ask me for some dough, he's very, very close to being a thief. Especially if he asked me before when I was sober and knew that I wasn't willing to agree unless inebriated. I think we should all agree that is a scummy thing to do. We recognize his intent was to get something out of me by making me unable to think clearly or withstand his persistence.

I would not consider it as rape if both of them are drunk. It would be, if the man was sober and the woman is drunk.

I don't think that's how it goes. One of them would have to be wasted out of their mind to the point where they are incapable of informed consent. If one was black out drunk and the other was tipsy, the tipsy one took advantage of the wasted one and that one is the rapist. If they were both equally wasted, then it is a grey area and much harder to determine who is at fault. In a case like that, I think intent comes into play a lot.

Also, it's definitely not always the woman who is raped. Men can be raped too, by women. My boyfriend was raped by a woman before he met me. He was 14 years old and he got into some alcohol that his parents had in the house because they were throwing a party. He drank to the point where he blacked out. He was told the next morning that a 17 year old girl who was there had taken his virginity. To this day he still struggles with what happened to him. If the genders had been reversed and he had had sex with a girl who was wasted, then he would have been the rapist.

e: I know that in all likelihood only the man will be prosecuted. But I've never heard of a legal code that would specifically state that only women are unable to consent while intoxicated. Especially since that would be unconstitutional in almost every democratic country.
