Is your non compete from the employer that just laid you off, or from an employer previous to this employer? Every non compete I have ever had to sign was no longer valid if the employer terminated the employment agreement. I had one company that didn't have that provision, and I refused to sign it, they modified it appropriately. The purpose of a non compete is so you can't gain marketable skills at their expense and then take it to a competitor, not so they can lock you out of a field that is possibly your most marketable area. Once they terminate the arrangement you are typically free to go to another company. NDAs and non solicits typically don't become invalid upon employer termination. I would also look into your state/country's laws regarding non competes. Some consider non competes that are not waived upon termination as unenforceable.

Over the last year, I have been paying 3k in alimony and 2k in cs for two kids. The legal fees where awful at least 75k. I already have given close to 250k in separation. I have been living off my 401k as it is all I have left. I am absolutely flat ass broke. I mean like 500 left to my name. She actually has everything we have, had.

I suggest talking to a lawyer about the non-compete agreement. I was in the same situation and after discussing with my lawyer, he said it would be unenforceable the way it was written and most courts would throw out any legal action.

They can't completely drive you out of the market you're in, especially if you've been getting offers (or you could just accept the offers and not mention the non-compete).

I was laid off too, divorce definitely took its toll on my psyche. I also pay $2700 per month just in child support, missed some payments but then found a higher paying job than I’ve ever had before. I bartended and worked odd jobs during the months I was unemployed, I’m a c level executive so it was quite a humbling but interesting experience .....also filed unemployment for the first time in my life - make sure you call the child support office to inform them of your situation and see what options you might have.

BTW ... I see people violate non compete agreements all the time. I suggest you get legal help.

Non modifiable. We came to an agreement at 3k because when we where at court they where pushing for 4 years and the judge has awarded this in the past in my county since we where married for 9 years and she did not work. I gave up the proceeds from the sale of our house to get it down to 2 years. They also where pushing for 75 / 25 split of everything and I was able to get it to a 60/40. Whole thing is a crock.

I lost my job too. I was unemployed for 3 months (and the new job paid 20% less). AFAIK tell the state you have no money to make payments and have the Alimony and Child Support moved to the 19th month and so forth until you find work again. Go to the clerk of the court and start asking questions. I did not know that was an option in my state and I ended up making things worse by taking her back to court to get what I could have negotiated for free.

So, so, so sorry this happened to you. When laid off I was the sole source of health insurance and money for my family and my wife was at Dr having that lump in her breast checked out. So sorry.

Unless you can confidently say that you can land another job soon that will let you pay off that absolutely batshit alimony payment I suggest you flee to a country that doesn’t have an extradition treaty with the U.S because if you can’t pay the Alimony they will lock your ass up without a second thought.
