UK prisons are purely misandrists : Male prisoners cannot refuse easily to be searched by a woman, male visitors can be searched naked but to search a female prisoner who attempted to escape you need special authorization.

India is in a state where a court order can cause:

  • unconsensual extraction of your sperm, in turn any other operation of their choosing as result of this precedent
  • unconsensual storage of your sperm
  • unconsensual impregnation of a woman with your sperm
  • unconsensual fatherhood
  • essentially rape by court order

Future prospects if this man survives:

  • this shit costing him a fuckton of money
  • having a child or multiple children the court will oblige him to provide for
  • even if he were to divorce and give up any custody, and despite only the woman wanting the child possibly against his consent, he will still be paying settlements and supports until he sits homeless on the street.

Enjoy your stay in India!

what happened to consent? lmfao ridiculous bullshit

[–]HitlerHistorian 43 points44 points45 points 5 years ago (0 children) | Copy Link

I'm trying to imagine a scenario where a wife is basically in a brain dead coma being injected with her husband's sperm to deliver a child. What a shit storm feminists would have.

[–]DouglasWallace 30 points31 points32 points 5 years ago (0 children) | Copy Link

Consent is for women. Only.

[–]Glocktopus1919 30 points31 points32 points 5 years ago (0 children) | Copy Link

"not in a condition to give consent = consent given"

Well he didn't say no.

The hypocrisy is disgusting and disgraceful beyond words

He was sexually assaulted.

[–]funkynotorious 51 points52 points53 points 5 years ago (15 children) | Copy Link

This is nothing what if I tell you there is a law in India which basically gives the power to a wife that she can basically send her husband and his family to jail just on the basis of an accusation.

[–]-NotFBI-agent006- 15 points16 points17 points 5 years ago (1 child) | Copy Link

Wait send the family to jail as well for an accusation, wtf

[–]manicraccoon 6 points7 points8 points 4 years ago (0 children) | Copy Link

Yes.

[–]Rockbottom503 19 points20 points21 points 5 years ago (9 children) | Copy Link

I'd say I've seen the reports and there's not alot that could shock me. Stuff like this is new and dangerous though. Men have no control over their sperm once it's left the body, things like this set precedent that they have no control over it before it has left their body also. If the guy recovers and it transpires he didn't want kids, the state is still going to hold him liable to support those children despite the fact he has had literally all choice removed.

[–]duhhhh 16 points17 points18 points 5 years ago (8 children) | Copy Link

Men have no control over their sperm once it's left the body, things like this set precedent that they have no control over it before it has left their body also.

I believe India courts already set that precedent by mandating men give their wife sperm so they can impregnate themselves during divorce pproceedings.

This was the first thing I thought of. So fucked up.

[+]Sora20333 -19 points-18 points-17 points 5 years ago (6 children) | Copy Link

This had nothing to do with what happens in India, this is a woman who's husband was dying, practically dead already and she wanted a son by him to remember him by

[–]duhhhh 14 points15 points16 points 5 years ago (3 children) | Copy Link

Did you read the article I linked? The courts in India have already said even mentally sound coherent not dying men do not own their sperm, their wives have a legal right to it. The case in the top article changes nothing.

[+]Sora20333 -15 points-14 points-13 points 5 years ago (2 children) | Copy Link

That's not my point. The article you linked is helpful, and I've read it before, but my point is one has nothing to do with another.

[–]duhhhh 5 points6 points7 points 5 years ago (0 children) | Copy Link

That's not my point. The commenter above me said this case could set the precedent that men have no right to control their sperm before it leaves their body. That isn't true because that precedent has already been set for an able bodied man unwilling to give his sperm. There is no slippery slope starting from this case. The courts previously hit rock bottom.

[–]Rockbottom503 7 points8 points9 points 5 years ago (1 child) | Copy Link

Children aren't trinkets to shove in a memory box.

[–]LettuceBeGrateful 2 points3 points4 points 5 years ago (0 children) | Copy Link

Nonsense. Memory boxes come in all variety of sizes these days, I'm sure she could find something.

[–]coloradocaniac 1 point2 points3 points 5 years ago (0 children) | Copy Link

That is disgusting.

[–]name2electricbogalo 0 points1 point2 points 4 years ago (1 child) | Copy Link

I'm pretty sure men aren't protected from rape in India

[–]funkynotorious 0 points1 point2 points 4 years ago (0 children) | Copy Link

Yes

[–]DouglasWallace 13 points14 points15 points 5 years ago (4 children) | Copy Link

I've been saying for years that this is coming to us all. The push for men to not have legal ownership of their own sperm is quite old now.

About ten years ago, there were two or three cases in England in connection with this, where wives wanted to be able to control whether a man donated sperm [a man who does so is an idiot in my mind, but that's a different matter].

About five years before that, there was a case in the USA - Iowa I think(?) - where a dying man had his sperm extracted after he was able to give consent.

In Nigeria, and some other Muslim countries, the man's sperm (like most of him and what he does) belongs to his wife. Even in cases of post-separation, she can demand sperm from him while still his wife.

In many jurisdictions, if a man (mostly a husband) has sperm lodged anywhere, his ex-wife/partner can get access to that if she wants, which can make him liable for around $¼m. [If you have sperm stored anywhere, destroy it as soon as your relationship hits the rocks!] If the man dies, under the laws of bailment, stored sperm become part of his estate and can end up with entirely the wrong woman, who can thereby create a child which she can make a claim on the estate for the upkeep of.

And now this decision in India.

It's coming to a place near you. Already, at the United Nations there is discussion that refusing to get a female partner pregnant is a form of domestic abuse. You can imagine where that leads to: a man's sperm doesn't belong to him, even though he is financially liable for what results from it.

Can you link me to the sources of your last paragraph. I also read that but I could not find it anymore.

I remember it wa a big US feminist organisation

[–]DouglasWallace 1 point2 points3 points 4 years ago (0 children) | Copy Link

As I've just responded to another poster, that's the one that could be tricky to discover by an internet search. I've added it to my 'to do' list and will try to find it again.

[–]Super_Discussion7161 0 points1 point2 points 4 years ago (1 child) | Copy Link

Do you have sources for any of that?

[–]DouglasWallace 0 points1 point2 points 4 years ago (0 children) | Copy Link

It's not an area of men's rights that I concentrate on, so I don't have a document on it, sorry. I'm sure if you look around the internet, you would be able to dig it out, given the background information I have given. The only one that might be difficult is the UN one: I'll see if I can recall/find the consultation and policy building on that.

This isn't rape, they extracted his sperm so the wife could get pregnant and have his child after he died, they stuck a needle in his testicles and extracted the sperm

[–]bufedad 11 points12 points13 points 5 years ago (7 children) | Copy Link

Oh yeah, forcing a woman to become pregnant with a needle instead of sex wouldn't be considered a sexual violation of any kind...right?

[+]Sora20333 -8 points-7 points-6 points 5 years ago (6 children) | Copy Link

You're assuming that this was a split second decision on the wife's part, you don't know that the husband hadn't told her that she could do it or that they were speaking of it before his condition deteriorated, and yeah it would be rape if this was against his will but we don't know if they discussed it or if he gave her his consent before he died you're assuming that she did this with no thought or consideration for her husband

[–]bufedad 7 points8 points9 points 5 years ago (5 children) | Copy Link

You're assuming that this was a split second decision on the wife's part

Oh, so your opinion is that husband's shouldn't need a wife's consent as long as they put in a lot of thought about it...interesting

[+]Sora20333 -7 points-6 points-5 points 5 years ago (4 children) | Copy Link

Why not? If the husband and wife decide on something before one of them is unable to give medical consent I see no reason as to why they should be denied to go through with it. If the wife told the husband that he could then there should be nothing stopping him and vice versa, this entire fucking comments section is going on the assumption that the wife did this without consulting her husband that she saw him dying and said huh I want his baby. For all you fucking know they've been trying for a baby for 2 and a half years and this was her last damn chance to have his child you inbred fuck. Crawl out of your goddamn parents basement and actually live life instead of basing your entire beliefs off of one damn subreddit.

[–]bufedad 6 points7 points8 points 5 years ago (3 children) | Copy Link

Why not? If the husband and wife decide on something before one of them is unable to give medical consent I see no reason as to why they should be denied to go through with it.

You see no reason why consent would be required? Holy hell, you must be a feminist.

[+]Sora20333 -6 points-5 points-4 points 5 years ago (2 children) | Copy Link

Ha you're funny. I'm no feminist, trust me, I'm just making the argument that it is possible that the wife did get her husband to agree to what she did before he went into a coma, again we don't know.

[–]bufedad 6 points7 points8 points 5 years ago (0 children) | Copy Link

I'm no feminist, trust me,

Very few people, aside from feminists, consider consent to be irrelevant.

I'm just making the argument that it is possible that the wife did get her husband to agree to what she did before he went into a coma

So, if a wife agrees to sex before she goes into a coma, anything he does afterwards sexually to her can't be rape... right?

[–]d3ch01 3 points4 points5 points 5 years ago (0 children) | Copy Link

What are u talking about dude... like wtf. U have no facts. Ur argument is based on guesses. He was raped. He needs to give consent in that moment for that circumstance for it to be just

[–]SamaelET[S] 8 points9 points10 points 5 years ago (8 children) | Copy Link

It is a question of consent.

[–]Sora20333 -5 points-4 points-3 points 5 years ago (7 children) | Copy Link

Sure, maybe, but these two were married for who knows how long, we don't know as the article doesn't say, as the wife can still make medical decisions for him we have to assume that the husband trusted her and maybe loved her, we assume that his state got progressively worse than what it used to be and it's possible that they spoke of it before he got to the point where he was comatose, again we don't know, all we know is that a woman is losing her husband to Covid, he will not survive this and she wanted something in her life after the man she married passed on, there's nothing wrong with this, it would be a totally different story if he came too and said that he wasn't okay with this but he won't, he's going to die, very soon.

[–]bufedad 7 points8 points9 points 5 years ago (6 children) | Copy Link

Sure, maybe, but these two were married for who knows how long, we don't know as the article doesn't say, as the wife can still make medical decisions for him we have to assume that the husband trusted her and maybe loved her,

So, if a court were to rule a husband could have sex with his comatose wife, you'd not have any issues with the consent involved?

I'm certain you'd have no hypocrisy there.

[–]Sora20333 -5 points-4 points-3 points 5 years ago (5 children) | Copy Link

Having sex with a comatose person and extracting semen or an egg is widely different, yes I'd have an issue with it, just as much as if the court said she could have sex with the man, she got the semen so she could go through IVF

[–]bufedad 9 points10 points11 points 5 years ago (4 children) | Copy Link

Having sex with a comatose person and extracting semen or an egg is widely different

Violating a person's consent and violating a person's consent are widely different?

[–]Sora20333 -2 points-1 points0 points 5 years ago (3 children) | Copy Link

You have no idea if the wife violated his consent, you're making an assumption that the husband and wife didn't talk about this before he got much worse.

[–]bufedad 7 points8 points9 points 5 years ago (2 children) | Copy Link

> You have no idea if the wife violated his consent

Yeah... we do. He didn't consent.

You just claimed that we can't know if consent was violated when a comatose woman is raped... consent is REQUIRED... not nice to have... REQUIRED.

[–]mikesteane 20 points21 points22 points 5 years ago (0 children) | Copy Link

[–]fanclockbedsheet 2 points3 points4 points 5 years ago (2 children) | Copy Link

Genuine question, can they "extract sperm" in some non sexual way or did somebody literally jerk him off while he was unconscious? (sexual assault)

[–]d3ch01 5 points6 points7 points 5 years ago (0 children) | Copy Link

Idk. It would be worse if they did but it's still terrible even if they hadn't

[–]IBeMadToo 0 points1 point2 points 4 years ago (0 children) | Copy Link

Did it through an IVF/ART procedure.

[–]michaelscott1776 3 points4 points5 points 4 years ago (0 children) | Copy Link

Right so if I want to have a kid I assume it's alright if I just go ahead and rape my girlfriend while she's in critical condition at the hospital?

it’s india, any surprise? still, things NEED to change.

[+]Sora20333 -22 points-21 points-20 points 5 years ago (29 children) | Copy Link

I don't understand why this is such a terrible thing, her husband was dying, it makes sense she would want to have some kind of memory of him to keep her going throughout this tragedy. You people will jump on any chance to demonize women

[–]bufedad 14 points15 points16 points 5 years ago (0 children) | Copy Link

I don't understand why this is such a terrible thing

No, you clearly don't understand why consent is important.

Missed this part:

You people will jump on any chance to demonize women

Demanding bodily autonomy and consent be respected is demonizing women.

I mean, it's not like we don't already know feminists are pro-rape.

[+]Reasonable_Feed161513 points 5 years ago [recovered] (3 children) | Copy Link

In your mind a memory of a wife is more important than the consent of a husband?

Speaking like a true misandrist and rapist.

[+]Sora20333 -7 points-6 points-5 points 5 years ago (2 children) | Copy Link

I sound like a rapist? Again you know nothing of what happened before he got sick, having a child is not something you decide to do overnight, it is very likely they've been trying for a child for some time, you don't know one way or another you're simply assuming the man had no say in whether he had a child.

[–]generaluser123 8 points9 points10 points 5 years ago (0 children) | Copy Link

So do you claim to know what that man wanted or you just made assumptions which suited your narrative?

[–]p3ngwin 14 points15 points16 points 5 years ago (0 children) | Copy Link

it makes sense she would want to have some kind of memory of him to keep her going throughout this tragedy.

It makes sense what she WANTS, that doesn't make sense for HOW she gets it, CONSENT is NEEDED.

For all the West's rhetoric about "consent", and "men need to stay out of women's body autonomy" it's funny how some people are fine with men's autonomy being non-existent eh ?

You people will jump on any chance to demonize women

This is nothing about demonizing women, and ALL about men's rights, in case you forgot what sub you're in ?

[–]Right_Pepe 22 points23 points24 points 5 years ago (18 children) | Copy Link

Had the husband gave his consent?

[+]Sora20333 -7 points-6 points-5 points 5 years ago (17 children) | Copy Link

It's possible they were actively trying for a baby before he got sick.

[–]Right_Pepe 19 points20 points21 points 5 years ago (16 children) | Copy Link

But had the husband consent? Ain't it suppose to be a 2 person must agree thing? Plus. I don't think the husband will want somebody jerking him off when he is dying. Like just give him some final peace time.

[+]Sora20333 -10 points-9 points-8 points 5 years ago (15 children) | Copy Link

No one's jerking him off for one, they stuck a needle in his testicles and extract the sperm that way, secondly the husband was dying, he was comatose unable to speak and will likely die in a few weeks, he couldn't give consent which is why she needed a court order and there's nothing wrong with that the wife wanted to have someone in her life after the love of her life was dead.

[–]generaluser123 6 points7 points8 points 5 years ago (9 children) | Copy Link

Would like your thoughts on the following questions

1) What if the man survives and mentions that he never intended to have children or that he simply changed his mind?

2) What if they get divorced later on in life and then will he be responsible for childcare or payments?

3) What if genders were reversed and it's the women whose egg needs extraction?

4)What if the man gets a complication as part of the procedure which contributes to his death sooner?

[+]Sora20333 -6 points-5 points-4 points 5 years ago (8 children) | Copy Link

1.) As I said earlier which you may have missed if the husband woke up and said that he never intended to have a child then the wife is completely in the wrong and needs to stop whatever treatment she's doing to get pregnant.

2.) It would depend on whether the first scenario happened, if he raised this child for let's say 5 years, then yes, I would say he should have to pay child support, if he got better and accepted the child as his own and willingly raised it with the mother.

3.) It would depend on the situation, if the man and woman had talked about it before she deteriorated and she had given him her consent then yes. (This is essentially what I'm basing my entire opinion off of in case anyone was wondering)

4.) I'm not sure what kind of complication can happen? But if he's on life support it won't matter whether he dies sooner or later, it's a machine keeping him alive, I'm not this person but I'd rather die than have a machine keep me alive.

[–]generaluser123 4 points5 points6 points 5 years ago (7 children) | Copy Link

"1.) As I said earlier which you may have missed if the husband woke up and said that he never intended to have a child then the wife is completely in the wrong and needs to stop whatever treatment she's doing to get pregnant."

So in your opinion the IVF baby should be terminated if the husband recovers let's say 5 months after the IVF process started? What if he recovers after the child is born?

[–]Sora20333 -4 points-3 points-2 points 5 years ago (6 children) | Copy Link

Then if he chooses to not take responsibility for the child than that is his decision. I wouldn't say terminate it out of principle but if that's the decision they both come to then yeah, but he has no obligation to take responsibility for it

[–]generaluser123 5 points6 points7 points 5 years ago (5 children) | Copy Link

So basically you said that the man would have a child having his DNA without his permission and then if he finds out and doesn't agree with what was done then still he has no recourse. There is a simple answer to all this dilemma which is not very hard to understand, the feminist favourite notion of consent but I guess it doesn't apply for men only a womens consent matters!

[–]Right_Pepe 8 points9 points10 points 5 years ago (4 children) | Copy Link

if that is selfish, what about using a child as a ticket to extract alimony?

A lot of comments here without even reading the article.

The couple is happily married, and most likely trying for kids like most indian couples. Husband gets serious covid. Wife wants kid from husband. Court allows it.

While this crosses quite a few lines, it doesn't really seem that wrong considering they were already trying.

What you people don't understand is how important kids are to some people and a sense of family. This kid would most likely be the the heir of the family. This kid is what would keep the woman going on without her husband. This kid is her connection to her marital home in the absence of her husband. If she has this kid, she's unlikely to ever marry again.

In certain places, marriage and love still holds sanctity, and it isn't necessarily a men vs women situation.

Indian courts have made some really shitty decisions, and there are extremely sexist laws, no doubt about that, but I don't think this is one of them

Doesn't matter, this is about CONSENT.

The sperm was extracted whilst he was still alive (but unable to grant consent). Even the hospital was refusing to extract and preserve the sperm because there was no consent from the donor. But the High Court overruled it.

Now if he said in his dying will that he consented to this, that's fine but that does not appear to be the case here.

Imagine if this guy survived, and decided he never wanted kids and to enjoy his life instead after being on the brink of death. All they have is his wife's word on how this man actually felt before and during having COVID in terms of having children, which may not reflect his actual wishes.

Even after death this would be considered unethical.

No. He's going to die.
