Shit never made it into court because everybody knew it was bullshit by the end of it.

I asked the cops about what's going to happen to her and they told me to just let it go.

There are laws against filing false felony charges. The thing is those laws are never enforced when a woman files a false claim against a man because activists claim it would have a "chilling effect" on other victims coming forward and the DAs always back down because they can't lose the female vote and stay in office. Once again, someone's potential future feelings being hurt is more important than upholding the law as long as the victims are exclusively male. Social security is no longer the third rail of politics- it's now the sisterhood.

The problem in the UK at least (I’m afraid I’m not familiar enough to comment on other countries laws) is that the only legal action that can be taken against false accusers (unless you take civil action) is that of perverting the course of justice or wasting police time this means that the crime committed is that against the legal process/ system, it does not consider the immense harm caused to the innocent victim.

Until victims of this crime and the damage caused to such victims are acknowledged and they are given legal status as victims, nothing will change.

How about police are not allowed to reveal the name of anyone accused of committing rape until there is solid, hard evidence pointing to that person? This would allow rape victims to still come forward, but leave the accused out of the picture until actual evidence is collected.

Read this book by John Jarrad. He is an Australian actor in the Wolf Creek series. He got accused of rape that was consensual sex 20 years ago. He lost all his work. He was called a rapist. Cost him more than $200,000 in legal fees. In the end the case was thrown out because of lack of proof and her inconsistent story. She left court with no costs and she cannot be named publicly. Disgusting!

Police use a blunt instrument with this, and there are laws in place to make it nearly impossible for a woman to pull-out if she regrets making a report it and later changes her mind. "Victims will try to protect their abusers"- type thinking.

I went through the figures made public where I live to see if the feminist claim that only 0.2% of abuse accusations were false held any water. Turns out that 0.4% of cases that get thrown out of court get investigated - and of those investigated 55% are found guilty. So only 0.2% are PROVEN to be false because a tiny amount get investigated

On the other hand of the spectrum, even with a law that states that only "with the credible and not contradictory testimony of the woman" is needed to determine a man guilty - only 22% of cases of the total brought to court are judged guilty. With that lenient standard between 0.4% and 78% of accusations are false and we simply do not know where the correct figure lies because we do not investigate.

The question should be why judges are not investigating obviously false accusations (seriously, there were outrageous public cases where accuser contradicted themselves, other witnesses, evidence, or was caught lying that did not get investigated)

Police and prosecutors have often been caught out doctoring evidence to get prosecution - eg. in Mark Pearson's case they doctored the cctv as it clearly showed he didn't grope anyone.
The big problem is there's no public disincentive for the loonies to make a false claim, typically a lower status women who slept with a higher status man who doesn't really want a relationship with her - 'victim' name suppression means her name can never, ever be published, whereas he gets dragged through the mud. Now, functional middle class girls from good families usually don't want to spend months of their time being scrutinised and providing evidence for the prosecution in false-claim vendettas, additionally those in their circle probably will find out what happened and she will be ostracised in that circle (eg. university) by everyone male and female alike. So this is a disincentive. A loony girl from a bad family with bad social status anyway doesn't really have this to lose.
Making a false report is a crime in most jurisdictions, but hardly ever prosecuted - if it were, the jails would be full of mentally unhinged women who had falsely accused men of rape. The UK is better than USA and most western countries on prosecuting women who make false claims where there is clear evidence (usually, her X rated messaging history, eg. boasting to her friends or her 'attacker' how much she wanted and enjoyed sex with him).

Look at what happened to John Leslie, Matthew Kelly and Cliff Richard. Not a shard of evidence against either of them but their names have been smeared and it ended John Leslie's TV career.

Serial false accuser Jemma Baele from England falsely accused about a dozen innocent men, one of whom spent 2 years in prison. It is good she was finally sent to prison herself, but only after she had falsely accused a dozen men.

So there was a case a couple years ago where a woman lied about rape by two men to hide a threesome from her boyfriend. She received jail time but I remember being upset that it wasn't as long as what the men would have faced if they did rape her (she even rolled her eyes i was fucking pissed). There are consequences but I agree that it's not enough. I hope the guys on here know that most women care about this too, as do feminists. I'm one of them. Equal rights should mean women should face consequences for their actions too

I can only speak from the viewpoint of a female victim of sexual assault and rape.

I met with several police officers, had several investigations, went to court three times and the end result was that there wasn’t enough evidence (which i suspected, i never reported it, i taked to a school counselor and she has to report it by law, i did this a week after it happened so a rape kit wouldn’t work.) i never wanted to report it because of the strain it would put on my family and how I didn’t want them or my friends to know.

I call bullshit on victims refusing to come forward because of laws that prevent FALSE accusations to pass, if anything they refuse to report on the basis of not wanting anyone to find out and self-hatred/self-devaluing.

Because if their case is in fact a real case, then it won’t pass as false, it’ll pass as not enough evidence which means that nothing happens, all the victim can really do is remove themselves from the perpetrator’s life and so their best to move on (preferably with friends they can trust and LOTS of therapy).

On the note of all this, there has to be a change to how the law sees female on male sexual assault and rape, its just as bad just as it is but even worse with how these men/boys are met by family, friends and everyone else on the matter.

Here is the law in Norway when dealing with false rape accusations:

According to section 225 of the Penal Code, it is illegal to report a criminal act that has not been committed.

According to the same section, such a false report can be punished by a fine or imprisonment for up to 1 year.

If the person reported was charged or convicted as a result of the incorrect accusation, the punishment is a fine or imprisonment for up to 3 years in accordance with the Penal Code § 222.

However, if the false accusation is considered serious, the penalty increases significantly. Such an accusation can in fact be punished with imprisonment for up to 10 years. In deciding whether the accusation is serious, emphasis shall be placed on the consequences of the accusation or could have had, the nature and content of the accusation and other circumstances.

There is reason to believe that most rape allegations will be considered serious. However, this must be decided on a case-by-case basis.

7 months imprisonment is the norm. Three of these are unconditional with a probationary period of two years.

There are no statistics on false rape accusations. The Oslo police manually retrieved false accusations / reports in rape cases for the period 2012–2017. Of well over a thousand rape cases, 69 cases, according to the police, were reported falsely. In 21 of these cases, the police investigated the case as a false accusation. Four cases ended with indictment and only one with sentence.

Punishment for rape:

The rules for rape are regulated by section 291. It appears from section 291 that rape is punishable by imprisonment for up to 10 years. This means that in principle the maximum penalty the perpetrator can receive is 10 years. This does not mean that the perpetrator will always be sentenced to 10 years in prison.

It follows from court case law that the prison sentence should be set at around 4 years.

In the case of aggravated rape, the penalty will be even longer. Here, the perpetrator can be punished with imprisonment for up to 21 years. This also applies to rapes that are not aggravated, but where the perpetrator has previously been punished for rape.

It follows § 293 that in the assessment of whether the rape is serious, special emphasis shall be placed on whether the rape was committed by several people jointly, the rape was committed in a particularly painful or particularly offensive manner, or the victim dies or suffers significant damage as a result of the act on body or health.

In my country (Israel) if a woman gets proven that she created a false rape accusation she would serve to 1/4th the sentence the man would have served if proven guilty. It's obstruction of justice. But in the US a woman could just walk away it's mind boggling.

We need to make rape a more serious topic. Not a joke like it is now. I believe making it more serious in the eyes of the public would help a lot. Also, the stats are clear, say 1,000 men rape 1,000 different women. 50 will be taken to court, 10 will be tried and only 1 will actually go to prison. I believe what you may be reading is the same idea of “you have to take bad ratings on a restaurant with a grain of salt because people only rate when they’re mad.” So you’re just reading a lot of posts about it, because only the most mad are getting notoriety. I do believe it’s wrong for someone to falsely accuse another of rape. That person should be charged. However, it is easy for me to understand the view point of “it may make women less likely to testify”

There are clear laws both against lying to the police and making false allegations. Perjury is even a felony in the common law system. So calling for specific legislation is a bit like when feminists called for specific legislation against marital rape, intimating that it was legal before - it was, of course not (although of course we might have been less likely to intervene in the private sphere, but that was if so cultural and institutional, not legal).

The problem, of course, is the inverse of why it is hard to convict people of rape: there is rarely clear evidence either of guilt or an outright lie. The cases where false accusations have been sanctioned are, I think, the exceptions that prove the rule, where the accuser was foolhardy enough to make things up that could be disproven - and at times making up the encounter altogether.

Another important point to keep in mind is that we do not want to give false accusers a strong disincentive to come clean. If you false accuse someone of rape and change your mind, you will decide not to come clean if the consequence could be a felony conviction. We might think that they deserve it in some of the more egregious cases, but we also have to keep in mind that whenever we use the force of the law, we create trade-offs that might be worse than the problem we are trying to fix (just think of gender quotas).

My own wife claimed I raped her during a custody dispute. I've spent $150k in legal fees so far and it's been 2 years and still not over yet. Her false testimony was enough for the government to give her my $1 million dollar house (called exclusive posession of the matrimonial home) and get de facto custody of my kids which she hasn't allowed me to see for almost a year.

Just one false allegation. From my own wife.

Defamation laws exist. They protect those who have been wrongly accused of crimes when those accusations are untrue and have caused damage to the person's reputation. The law allows those falsely accused of a crime to pursue a cause of action in court, generally based on defamation of character, which requires the accused to prove that a false statement was made, the statement was conveyed to a third party and that statement caused harm.

Edit: if you think it's difficult to win a defamation suit, imagine how difficult, both legally and emotionally, it must be to win a sexual assault case and "get back your reputation".

There are, but there is no political will to prosecute. Law enforcement has an incredible amount of discretion when handling this as well.

If there are formal charges brought and they determine it was a lie, they can modify the case to include the change of the report to be a false report to police where the so-called victim is then made the suspect. This is exceedingly rare. More rare is a prosecutor's willingness to prosecute the liar.

Law enforcement will have the option to simply say there is "insufficient evidence" and therefore nullify the claim without pursuing any motive or alternative investigation to defend the would-be victim of false accusation from false reports.

Law enforcement, further still, can determine convincingly that a person lied and rather than submit evidence proving a lie in the report, they can simply determine the original accusation was "unfounded".

The full spectrum of how often, the reasons for, and what law enforcement deems proper vary widely.

What left-wing/anti-male/feminists will say is that because so few women are accused, *prosecuted, and** convicted* that it must not be a widespread issue.

This is as grotesque a manipulation of multi-variant analysis as the wage-gap myth, rape culture myths, domestic violence myths, etc.

Most mothers teach men to be strong and always protect women and not hurt them even if women hurt him first. That's just how we have become. We need to take the opportunity to personally educate young men on women and how they really are. The only way we dig out of this hole, is if we as men band together the same way that feminists have.

You can file a defamation lawsuit just like with any other false accusation, the court's way of prosecuting rape is exactly the same as other crimes, if you define "fasle accusation" as unproven putting in laws that punish people who can't prove they were raped will only harm people who come forward after 10 years or so.
