Pretty sure it's the first life sentence passed down to a woman or a man for rape. If anyone gets a life sentence there was much more involved than rape. Rapists rarely get punished, let alone with any jail time.

I’ve known multiple child molesters convicted of felonies get only probation or parole, or just a couple years. This is not near a guaranteed sentence for child sexual abuse (though arguably it should be because recidivism and the way child molesters are not reintegrated).

Technically, no one is found innocent. They are found not guilty, due to the state failing to provide adequate proof of guilt.

But I agree with the spirit of your post and it seems reasonable that most folks who are not convicted are likely innocent.

That's true. We have a presumption of innocence. But courts do not find a person innocent. They find them guilty or not guilty, as allowed by evidence. If a person is found not guilty, it isn't because they were proven innocent. It's because the state could not prove guilt so the accused is presumed innocent.

I would argue a person is never found not-guilty.

You enter court innocent.

You can leave innocent or guilty.

For example, if a person is found guilty in a court, and then it’s determined that it was a case of mistaken identity, was that person innocent, or simply not-guilty. I would argue that the person was innocent.

If we start from the premise that someone is guilty and needs to prove their innocence then it skews the entire legal system in a different direction then if we start with the premise that they are innocent.

No. Just one count of forcible rape in Missouri is enough for life. I’ve seen a guy have 240 years for 3 rape charges he drove around and abducted women off the street. I also saw a guy get 25 years for smashing some chick who was jogging at noon in the face with a rock, raped her then broke her neck. This scum is now “trans” and will be getting out of prison next year after serving 3 years because “I’m cured!”

On March 24, 1932, the Alabama Supreme Court ruled against seven of the eight remaining Scottsboro Boys, confirming the convictions and death sentences of all but the 13-year-old Eugene Williams. It upheld seven of eight rulings from the lower court.

Well the supreme court decided the boys due process was violated, but that didn't make them innocent. so what was the solution?

to move the trial to KKK country near where the "victims" lived to get them a "fair" trial.

The jury found the defendant guilty of rape, and sentenced Patterson to death in the electric chair.

there's a lot of info and I got caught up reading about a few trials but regardless people have been sentenced to death for rape.

in fact it seems that was the norm for any black man caught having sex (consensual too) with a white woman for many years.

and if they weren't then the community would just get together and lynch them anyway... Like little Emmett Till who was brutally lynched at 14 for "offending a white woman"

i agree, but it’s a messed up debate. In Norway, even fucked up people get the right treatment to be somewhat fixed after some time. The jails are more about helping people adapt to the society than punishing people. I think the absolute max sentence here is 30 years or so unless you’re messed up mentally, in which case you can be held up for as long as needed in mental hospitals.

I mean, fuck this disgousting person, i don’t want to defend her at all, but she’s still a human with essential human rights, or what? I guess you could argue that something like this might be inhumane enough for her not to deserve her human rights, but maybe after good treatment she’s better? Hell if i know.

Are you suggesting it is a basic human right to be free from incarceration despite your actions, or are you saying that life in prison is itself a violation of human rights? Yea, that human rights part was a bit stupid i guess. I Think life in prison feels alot like death penalty in my head (just with longer wait time).

I’m no lawyer, but i think pedophilia should fit into the mental problems category. Meaning that if they would probably be closely monitored if they’d get out in public. It does however seem worrying if those people are allowed too much freedom. From what i’ve heard aswell the statistics of repeating a crime in Norway after jail is wayy lower than especially USA (don’t think i’ve heard it be compared to anyone else before), and i think they take a repeated crime way more seriously than the first crime. Then again, i get your point in that they seem to be balancing on the edge of the risk you should be allowed to take concerning safety of sivillians.

That system does not work the way people think it does. Norway always points out its low recidivism rate compared to the US, but what people don't realize is the US and Norway measure recidivism differently. The US counts even being arrested once out of prison under their recidivism while Norway you actually have to go back to prison to be counted.

Life in prison is also often about 30 years where I'm from. In just my old neighborhood I can remember 3 times where someone got or of prison and moved in with a relative then got murdered less than a month later. If the culture of your citizens wants the death penalty you better have REAL life sentences or executions because if you don't you're just creating situations where otherwise lawful people might become murderers.

Its not like someone getting life in prison for stealing or selling drugs. Rape and murder among other violent crimes, are things you should get life for. I can't see anyone who would rape someone (let alone a child) turn their life around and be a stand up citizen. I don't want that type of person to be able to do it again.

I see where you are coming from but all research on the subject disagrees with you. Many people who commit violent crimes are able to turn their life around. Life sentences are not good for a society as a whole but it might give you the justice you are looking for if someone hurt you or one that you love.

The US has the highest incarceration rate in the world an yet you see more violent crimes in the US than almost any other country. That should be all the proof that you need to confirm that long prison sentences doesn't help society as a whole.

This is pretty common trend for any addiction and applies to most crimes. Once someone kills, steals, rapes, abuses drugs, eats too much etc, they often go back despite therapy and even harsh punishment. It's most likely that this woman was a repeat offender, did not acknowledge the wrongdoing on her part, and displayed no shame or ability to empathize with her victim. It may be hard for you to accept, but some people are biologically incapable of thinking in a way necessary to prevent themselves from doing something wrong. There's simply no such thing as rehab for a psychopath. It's like giving rehab to a blind person like they will be able to see again if they change their behavior.

It's generally better to confine these people indefinitely before they themselves confine others to any more life long consequences.

I don't "seem to be under any impression." I was personally victimized by the American criminal justice system. It is a broken system on so many levels and it permeate all corners society, this sub included. I am making a general statement that this sub is missing the point completely and is in fact symptomatic of the ideology of individualism that pits one agains another rather than engendering a community that seeks rehabilitation over retribution. This whole sub exists because a subset of men believe that women aren't punished as severely as men are for the same or similar types of actions. So we celebrate punishment as though this somehow makes up for the injustices we as men perceive thus only perpetuating the cycle of retribution over rehabilitation. But everyone has decided that I'm focusing on this one individual case and not discussing a general concept because deep down you're hurt and angry and scared and alone and that's exactly what a good consumer is supposed to feel.
