Okay, that's pretty bad.

When police arrived, McClellan told them Brylee had been in a car seat and she wasn't sure who was driving, charges state. When she learned the baby had died, however, she told police she knew she and Fuller were both drunk when they got into the car, and that Fuller was the driver.

Lying to police, getting into a car without a seatbelt, WHILE holding a baby, with a drunk driver? That is definitely a slap on the wrist. Putting your child in danger, other drivers in danger, yourself in danger, and not even taking precautions while doing it is severe criminal neglect at the very least.

Birth control is free and easily obtainable.

Thank the republicans for "sex education" in schools. There are unfortunately too many teenagers who do not understand how babby is formed. It doesn't surprise me that some of them get pregnant and if they have an uneventful pregnancy don't even know they are pregnant. I've seen some pregnant teens who had a really tiny baby bump right up until they delivered.

True, that is undoubtedly a part of the problem, as education is important.

But I have a lot of difficulty feeling any sympathy for ignorance in today's world. EVERYONE in America has access to the internet, the largest collection of knowledge in human history, and most people have a god damned super computer in their pockets. If they stopped instafacing and taking selfies and googled "how does sex work", they could have easily solved the issues before they arose; they could also google "what to do with unwanted baby/unwanted pregnancy" if they were too dumb to seek preventative measures. They would then stumble upon the solutions listed above. This isn't the eighties, people are just too god damned retarded to use the resources they have at their disposal.

I personally think the punishment is fair for the crime, considering that she wasn't the one driving (I bet the driver is most certainly a felon now). The question is, would a man have received a harsher punishment? Maybe, in fact, probably.

That being said, I think that neither she, nor a man who committed the same crime, should be punished further than she was.

As a parent its your responsibility to care for your child. Not putting the child in a child seat is as bad as some dick putting a child on the back of a motorcycle and riding around. That's your responsibility and for literally killing her child, she is responsible. There are plenty of folks who believe holding a child in their hands is safer than putting them in a child seat. Her sentence is a joke.

You're deep in denial. The epidemic of women getting a lighter sentence in this country is pretty prevalent. This woman chose to get into a car drunk and on pills with her friend in the same state and also chose to carry her baby. Glad this isn't even her first offense for a number of issues. If you think that sentence is valid then ok. I'd like to see you think the same I'd your SO decides to be a selfish prick and ends up killing your child. You somehow seem to believe probation is enough to teach her a lesson. Her past sentences and fines are proof she has clearly learned nothing and just escalated callousness. The woman's life is over at this point. She doesn't have another infant to put in danger, and if she did, rights would be taken away. She poses no threat to anyone but herself. Probation means if she fucks up again, she will go to prison. There is no reason to waste taxpayer money in locking her up.

Prison should not be seen as punishment, and that's the way you look at it. It should be seen as an institution that separates serious offenders from society, that's it.

Prison shouldn't be seen as a punishment but probation is not a punishment either. This woman still has the ability to procreate again. A better system should be in place like forcing her to go to AA. But unfortunately that's not the problem the courts care to solve. That's more of a systemic issue and with regard to that you are right. I just see this as a careless selfish human who has no regard for her life and others being allowed to go back to her life.

I guarantee that AA will be part of her probation requirements. Usually you get random testing for all drugs, including alcohol. There's always ways around it, but if she gets caught once, she will go to jail.

A school friend of mine did this. Held his baby in his arms in the front seat of an overloaded car. They had a crash on the highway, and the baby was ripped from his arms, and went through the the windscreen.

I don't recall the legal repercussions, but he is a completely broken man.

Well it's not illegal to be a passenger in a car. It's also not illegal to be a passenger in a car whose driver is intoxicated. I think it is illegal to be in a car without your seatbelt and to fail to put your kid in a seatbelt.

And the mom is probably out of her mind with remorse and grief. How is justice served by putting her in jail? She'll be in her own (mental) prison for the rest of her life.

Look. I'd never have an abortion unless my life was a stake. I've actually gone trough 5 1/2 years of infertility and am currently 10 weeks pregnant, so believe me when I say I love this shit out of this baby and my child.

There is one simple fact that is the end all be all of the abortion debate. A person can not be forced by anyone to use their body to keep someone else alive. Say for some reason a parent, spouse, or even your own child needed blood/an organ and for some reason you where the only viable match. No one could force you to use your body to keep them alive.

Women can not be forced to use their body to keep a fetus alive if they do not wish to do so.

People talk about this right to life or whatever. But the fact is, the right to use someone's body to stay alive doesn't exist. For anyone.

Did you know, that legally, removing a dead fetus is reported as an abortion. Because medically that's what it's called. Fuck, I have to report my miscarriage at 7 weeks as an abortion to new doctors. Because medically that's what it is.

Just a correction.

The heartbeat happens at 3 to 4 weeks after conception.

At 17 weeks (beginning of second trimester) the brain starts to control bodily function, including heart beat.

A baby can begin moving in the womb anywhere between 16 and 23 weeks (second trimester).

All of those are demonstrably wrong.

I'm not saying abortion is right or wrong... but your "facts" aren't true.

You are incredibly wrong about there not being a heartbeat before the third trimester. You can actually see it at the 6 week mark, and is called a fetal pole. Source, army medic who did tons of vaginal ultrasounds for soldiers families. You are also wrong about the brain, as that also forms just after the heart, and has measurable activity. Then, on the third reason you gave, motor activity, that starts in the second trimester, as any pregnant women will tell you.

You are just blatantly wrong from a medical standpoint, and I think you should do some research next time. This stuff is all easy to find with a quick Google search. Pretty hilarious you have such a strong view on this topic, and are so wildly ignorant on it at the same time.

Now that you know this, does it change your view? I mean, every reason you believe abortion to be legal and just gave, was factually and demonstrably incorrect. Now that you know that, why do you still oppose abortion? All of that happens in the first trimester, minus motor activity, which begins shortly after brain development, in the beginning of the second trimester.

No you're right. I was mistaken and it's been a while since I've read up on it. There are different pieces of study on whether a fetus feels stimuli at the time.

Nevertheless no one is advocating this as birth control. The times a third trimester abortion happens is rare. If bc was more available in the market these debates would be a moot point. I do think that it would be nice to judge each case as it comes through instead of leaving it upto the state or feds to decide and make a dumb law across the board.

How can you say abortion isn't birth control, or advocated as. When about 90% of abortions are done simply because they don't want a kid? The fact is, needing an abortion because of rape, incest, or medical reasons, is actually a very, very small amount of the abortions being performed.

Anyways, I don't know why the argument always goes to rape, incest, or medical reasons when it isn't even close to the majority of cases. Actually, I do. Because if we were starting from the point of using abortion as birth control. The personal responsibility argument is easily won. So, pro choice people don't start there when talking about this. Turns out, it's even more. It isn't that I've been around enough women either. I've worked in healthcare. That is what I'm basing that on. Plus, the research I've already done on the issue. The main reason is contraceptive failure. But and however, contraception doesn't fail if you take it right 99.9% of the time. Basically, I forgot to take my pill a few times, had sex anyways, fully knowing that missing doses decreases effectiveness, got pregnant, and now I don't want it. Rape, incest, and medical reasons appear to be about 2% if I'm reading this study right. Don't take my word for it either. I think that pushing personal responsibility is the key. Currently, if you even dare to tell a woman she shouldn't have fucked so and so guy, without protection or taking your BC right, you may just get punched in the face. If we made people go to a class after they have the abortion to educate them on how choices have consequences, you are shaming womens sexuality.

Even so, the idea that birth control has given women more power and control isn't a logical deduction of the statistics either. Women's happiness is in sharp decline since birth control became widely available, and the civil Rights movement kicked off. Surely you won't tell me women are less free now, than before the first feminist movement. It actually seems like it has taken power away from women. Before BC, sex was seen more as a way of concieving a child, than simple pleasure. They basically gave up their biggest piece of bargaining power when it comes to a relationship. Now, men have become accustomed to women who have sex far more easily than fifty years ago. This is because the real risk of getting pregnant, and not being able to get an abortion, was a very real possibility. So, sex was under lock and key. Now, if a women doesn't put out quickly, the man will just find another in our society, as plenty of women are willing to, simply because the risk of becoming pregnant is significantly lower, and even if she does become pregnant, she can get an abortion. So, they have created a scenario whereas before, they controlled sex. Now, men do more so, simply because of birth control and legal abortions.

You would think that by introducing birth control and abortion to a society as a whole would stop single motherhood. Which is the single biggest deciding factor of how that person will do in life. A female child, raised by a single mom, has about a 30% chance of becoming pregnant as a teenager compared to about 4% when a father is in the picture. A funny thing happened when birth control came out. Single motherhood increased exponentially, especially in minority communities, where the number often reaches 70-80%. So, we have a ton of single moms, raising little ladies who have drastically increased risk of things like trouble with the law, drug addiction, even more unwanted pregnancies, all while now having to work full time to support the kid you don't even get to spend a significant amount of time with, and the cycle continues.

Well said. This has actually been quite informative. It is true what you say about education equates shaming women's sexuality since any form of education just equates some form of shaming or blaming. They act as though being well prepared is a bad thing. I've had the same argument about rape and educating women and men about the dangers about certain situations. They keep claiming educating people about the dangers of excessive drinking in a foreign environment equates to victim blaming automatically. It's like these mother's and Father's want to just produce clueless kids who make life altering mistakes and have to love with it forever. I can't understand why there's always that argument.

Even insects have the latter two, it's the first one that makes a person a person, and they just don't have it at that stage of development.

Even so, you are going a different route than i at this point. The question still remains of, if an adult can consent to sex, they have to be on some level consenting to having a child. I don't think there are many adults who are unaware that sex leads to pregnancy, and when you have sex, there is always the possibility. If you can't handle that responsibility, you sure as hell aren't capable of making decisions pertaining to raising a child.

I fully support applications to have offspring. If you apply, and are turned down, and have the kid anyways, you should pay a higher tax rate. Otherwise, it comes out of my check to put your ill thought out bastard through school, pay for the healthcare the parents probably can't afford, etc. Why should I pay for other people's bad decisions, instead of having them pay for it themselves? The short answer is because we've taken them out of the womb at that stage of development before, and there's just nothing there.

A longer, though still simplified, explanation is that we know this due to the presence of certain chemicals such as pregnanolone which the mother's body naturally produces and delivers into the fetus, keeping it permanently sedated and anesthetized long before even a rudimentary nervous system has developed. After the process of birth, these chemicals are oxidized when the infant begins to draw breath on its own and subsequently flushed out of its tissues, allowing consciousness to occur.

Other "building block" developments, such as mimicry and basic self awareness, then occur within the next two or three months, and develop onward from there.

Interesting about the prednanolone. I assumed something like this occured as a body is taken out of the womb. Reactions would need to take place allowing the baby to make the switch.

Roe v Wade is what I assume you are referring to. I would simply add that the issue of abortion is not evenly split among the population. There is still much conjecture about the case and how to interest it. Also, Roe v Wade has in place provisions to allow states to set forth regulations on abortion. Such as, time limits on when you can have the procedure done within.

It is still almost evenly split among public consensus. I think the reason why the argument keeps spinning is because we disagree on a fundamental level in regards to abortion. I'm really against late term abortion only. The best thing is to reduce the number of them that happen, I think we agree there. I would still rather see more in the way of personal responsibility when it comes to bringing a human life into existence. I simply believe there is something in the way of higher consciousness existing after a certain point of time during a pregnancy. That's where we will probably always disagree. It may not be fully human, but I still believe we shouldn't be killing them. At least not on a whim because a person hasn't thought it through. Again, that costs society in the long run.

Legally, in the United States, it works like this: You don't have the right to kill the fetus. You have the right to remove the fetus, and the unfortunate fact that it's unable to sustain itself afterward is a byproduct.

Similarly, should a child, parent, sibling, or even stranger undergo something like kidney failure, you're not obligated to provide them with one of your own kidneys. But, you don't suddenly have the right to kill them. Their impending death is considered a failing of their own body, one which you're not obligated to correct using yours.

Not accurate. Under the law a baby has no rights as it not considered a life until the 2nd-3rd trimester. I also think you may have a very naive understanding of how abortion works. Baby's are not simply removed from the mother. Understating the volent and destructive means of killing a baby as removal is absurd. There is no consideration for the life of the baby, as it is not considered alive. She was holding her child in her lap as a passenger in a vehicle being driven by a drunk friend. The drunk friend hit a tree and the baby died. It sounds to me like the friend killed the baby, not the mother. I'm not sure why the mother was even charged.

There are clear an obvious differences between a fertilized egg and a tumor. A tumor does not have the natural capacity to be an independent life form, as a zygote will often do. Life does not begin until the egg is fertilized by the sperm. Neither sperm nor egg will become a fetus alone. The masturbation argument is nonsensical.

Abortion is commonly used as a birth control technique, whether the parents don't feel ready, or aren't financially stable enough to care for the child, they still have a responsibility to the life they have created. In those cases where pregnancy threatens the life of the mother, of course abortion is justified.

The concept of the "unborn child" is a real one, and cannot be solely applied to those children who are wanted.

However, there are some important addenda which must be attached to a pro-life/anti-abortion argument in order to remain logically consistent and humane:

--pro comprehensive sex education (prevents unwanted pregnancies)

--pro affordable and accessible birth control (prevents unwanted pregnancies)

--pro universal healthcare (pregnancies and babies are expensive)

--pro affordable adoption (adoption is expensive)

--pro gay adoption rights (want to provide the child a loving home)

--pro paid family leave (missing work is expensive)

--pro affordable childcare (childcare is expensive)

--pro SNAP/WIC/food stamps (feeding a child is expensive)

--pro equal education (good schools are expensive)

--pro higher education funding (college is expensive)

--pro living wage (supporting a child is expensive)

--pro criminal justice reform (protect all lives)

--anti death penalty (protect all lives)

--willing to support all of these things with tax dollars and the vote
