What if I only agree to film on the condition that one person is allowed to view the content. That seems like a contract I should be able to enforce. Lots of situations call for Non-Disclosure Agreements. Why would this be different?

Even so, I'm struggling to see why the burden wouldn't be on the uploader to prove their partner consented. I imagine most couples who make sex tapes don't want to end up on the internet, so why shouldn't that be the default stance?

Hey I live in the UK. Age of consent is 16. I accept that people in their 30s are legally allowed to have consensual sex with 16 year olds. All I ask is that they behave responsibly while doing so and that they accept that I can quite legally judge them for doing so.

sex between a 31 year old and a 17 year old is not especially interesting as far as I'm concerned...sex between a teacher and a student though is VERY concerning no matter what the age difference.

This is one of those laws that are more concerned about "what MIGHT happen" rather than "what DID happen"...kind of like driving under the influence. If you're legally drunk and drive home safely without comitting any traffic offenses, you're still guilty of something we consider to be a serious crime. And if you're a teacher having sex with students, it's the same.

Just try to realize that the US, puritan-like perception of sexuality isn't something inherent, and varies from culture to culture.

The reason i say "14" is because that's about the age where women starts becoming attractive. Some say 12, some 13, some 14, some 15.. Some maybe higher. I say 14 is where I'd set it.

A 14 year old is not a baby.

edit: the median age for first menstration is 12,8 years of age. Most of them occouring in the 10-14½ age range.

It's federal law. By the letter of the law, anyone under 18 that takes a picture or video of themselves that's sexual in nature have technically produced child porn.

Teenage boys have been charged with producing and distributing child porn for sexting with their girlfriends. They have also been charged with possession of child porn for having pics and videos of their girlfriend. Unsurprisingly, girls don't get charged for it.

(A) enrolled in a public primary or secondary school in the same school district as the school at which the employee works; or

(B) a student participant in an educational activity that is sponsored by a school district or a public or private primary or secondary school, if:

(i) students enrolled in a public or private primary or secondary school are the primary participants in the activity; and

(ii) the employee provides education services to those participants; or

(3) engages in conduct described by Section 33.021, with a person described by Subdivision (1), or a person the employee knows is a person described by Subdivision (2)(A) or (B), regardless of the age of that person.

(b) An offense under this section is a felony of the second degree.

(b-1) It is an affirmative defense to prosecution under this section that:

(1) the actor was the spouse of the enrolled person at the time of the offense; or

(2) the actor was not more than three years older than the enrolled person and, at the time of the offense, the actor and the enrolled person were in a relationship that began before the actor's employment at a public or private primary or secondary school.

(c) If conduct constituting an offense under this section also constitutes an offense under another section of this code, the actor may be prosecuted under either section or both sections.

and, in this case. Prove that you were raped. Now the rape victim gets sued for providing evidence.

And no, i don't personally believe that it's rape. But minors "cannot give consent" to sex.

This dumb woman. Texas is a one party consent state for recordings. If one person knows theres a recording device, and the device only records that persons interactions, then it should be perfectly legal.

What he does with his property is his business.

I guess everyone caught by cctv cameras should sue those businesses too/s

i think to the effect of the evidence gathered (supposed illegally taken video without her consent was sourced from youtube). but yeah... the balls on this lady is ridiculous. she must be spending a lot of daddy's money to be wasting on such bullshit that is definitely going to be dismissed and lost on appeal.

I know of a couple of cases where a recording was produced to get off a rape charge, and the person filming was convicted for failing to prove they gained consent. Even when the female knew the filming was happening, was performing in front of a group of onlookers (was determined a private house had a resonable expectation of privacy), but they did not ask before filming.

Given the normal number of partners people have over their lifetimes you either have one heck of a thing for 31 year olds or your seemingly has a limited relationship with reality.

Still lets look at the numbers. Googling suggests that for a teacher in Corpus Christi you are looking at $40K per year. A 31 year old could have been teaching for a decade so with careful financial management they could have $100K on hand.

Isn't 17 a legal age? So that's not being a pedophile I believe because she isn't being charged with rape of a minor. She shouldn't be having sex with one of her students though and she should absolutely have to register as a sex offender.

Even if 17 isn't legal in her area, having sex with a 17 year old isn't pedophilia. Pedophilia is specifically and only sex with pre-pubescent children, and being attracted to pre-pubescent children. At 17, you're well past puberty.

Pedophile, much like the word rape, is used far too frequently, because its use conjures images of predatory monsters ravaging 9 year old girls.

There's really not much to be outraged about here...assuming you actually read the article.

She is claiming the victim secretly recorded the sexual encounter, then shared it with friends and allowed it to be uploaded it to youtube. That is a legally actionable offense.

People are getting wrapped up in the Victim vs Perpetrator here...when it's entirely possible for the sex victim to be a "revenge porn" type perpetrator...being a victim in one crime doesn't absolve him of another.
