I'd just make it so that the cheating partner gets a worse settlement because of it. But making it a crime would be stupid.

I think people would 100% still do it or divorce if still legal could happen for a dozen other reasons

Although it gives something to think about

If monogamy was more enforced somehow and I'm not talking like sending people to jail for having sex then would hope to see some kinda of benefit compared to how things are now
