Because it's family law that's the way it's designed. If you settle alimony she can always come back and get cs. You need a better attorney

Child support is a separate account for the kids held by the recipient parent, in theory. In practice, it's a slush fund for the recipient parent with zero accountability.

I see you're finding out the joys of the unfairness of being the higher wage earner. Like why are assets split 50/50 when the higher earner paid a higher percentage to purchase them while at the same time child support is calculated with gross income in mind.

Just wait until you find out that your child support will go up when your alimony ends.

Anyway, be pissed about it for the night, then wake up and realize you'll be better off in the long run.

So bottom line is the system is not fair. There are three categories in play: Assets/debts, alimony and CS. Each is calculated separated, however assets / debts and alimony can be negotiated. CS is suppose to be for the child, and can NOT be negotiated. It stands alone. However, as you are learning, the the way the system actually works the man (normally the higher earner) gets hosed.

Work out child support prior to final settlement, and make sure everything is 50/50 as possible. Otherwise she can come back and ask for more at any time...

Eg. I have no kids, and am currently paying my STBX ~$15k/mo in court ordered temporary support. Why?? Because she was a stay at home house wife (with no kids) and I am a physician that works a TON of extra shifts (would double up on work, then take long vacations). So I am being imputed based on my extra income for the last several years, not by base. And support is based on her need and my ability to pay :) So in theory she is getting ~50%, in reality she is getting 2/3 of my net base take home. So I have to keep working extra to cover her shit and my new stuff (rental, life, etc).
