If it’s not Iin the divorce agreement don’t pay. And pay the school directly.

No. You pay your child support obligation and then your finished. More cooperative parents can negotiate deals that pay for education or recreational stuff at the expense of giving up child support to give the other parent more time. But that takes a healthy ego from the custodial parent.

That’s entirely up to you. If you want to pay for your kids college, you’re more than welcome to. If you don’t wanna pay for your kids college, you’re more than welcome not to.

The same goes if you and your wife were married. There’s no legal expectation that you pay for your children’s college. Those are all personal decisions.

Am I missing something? What do you mean "do they fall under child support?". Child support ends in May, college starts after that. You won't have to pay both child support and college.

And as others have said, it's up to you if you want to pay your half of college. My lawyer said it was near impossible to get an enforceable way to have the other party pay for college. I wanted to have part of the equity of the house be put into our kids 529 plan to cover college, and he said unless both parties agree to it, it can't be forced.

At least in my state, Texas, people try to put college expenses in the court order but it’s not enforceable

Then it is over. If you want to pay for half of college that is up to you, if you want to set conditions with which you will pay for half that is up to you.

To put your mind at rest I was paying into a 529 for my child until the split, then I stopped since I needed the cash to pay for child support, I pointed out to my child that fact and she understands that she needs to take out loans for college or get the cash from her mother, the only thing that I cover is airfare for her to visit me at this point.

You are a free man at that point and may spend your money as you see fit.

Unless you have a divorce decree that states otherwise, you are not required to pay anything after your child turns 18.

Who is setting the expectation that you are paying for half? The state? You? Your son? The mother? Most states do not stipulate post-secondary education costs.
