My future ex-wife and I are going through the early to mid motions of a divorce and have two young children. We previously had an agreement about splitting time with the kids. But after she left and got a lawyer, everything's changed.
She's going for primary custody with me getting every other weekend and one evening (NOT overnight) a week. Words cannot describe how icky I feel with this power move she's pulling.
Have any of you experienced being bullied and forced into a parenting schedule that is less that ideal? We agreed to do this amicably; for the kids. But, she is, for the kids, now forcibly adjusting our schedule so that she gets them the majority of nights. I know eventually the court will look at the number of those overnights, combined with our incomes, to determine child support. I'm worried that me letting her get her way now will seal my fate later (in terms of not sharing everything equally).
I have a lawyer but am feeling really uncertain on how to proceed. Have any of you dad's fought for 50/50 and actually gotten it, much to mom's chagrin?
Thanks guys...I'm really f&(king low right now and just trying to keep it all together emotionally.

This guy is 100% right. Don't fall on your sword. Don't feel the need to be chivalrous. This isn't the time. Be strong. By keeping the peace, I mean limit arguing and bickering especially in front of the child. Also, do not ever email, text or leave aggressive, offensive messages. You be calm as a cucumber.

I keep hearing/reading.. don't move out. What's this mean really? Is it about ownership of the home.. or don't move out so that you are present in the kids lives?

Both. Assuming the home is marital property, if you move out and find other accommodations, you are telling the court that you don't need the home and can afford other accommodations. This makes it more likely your spouse will get the house in some sort of distribution of assets. As far as thr children go, you're going to argue that the kids are your life. Moving out doesn't illustrate that they are your world. You may also argue that the children have only known a world with you in it every day. You can't make that argument if they don't see you every day. It also gives your spouse a chance to argue that the kids are thriving without you and any disruption of this new status quo will not be in the child's best interests.

That was good info. Question on children.. if they are "of age" to say who they want to live with.. how does that play in to the whole 80/20, 50/50, full custody, etc fight? If for example my wife fights for 80/20, I want 50/50.. can I ask the mediator/court to ask my kid what they want.. and if that kid says to live with me instead of her.. do I now have 80/20? Also.. curious.. 80/20 vs full custody.. what's the diff? I think 80/20 is 20 gets kids every other weekend.. fri to sun. But full makes it sound like the one parent never sees kids.. which seems wrong.
