Her side is asking to setup mediation and suggested the name of a mediator.

I told my attorney that I don’t want to go into mediation without first seeing their proposed settlement and that I didn’t want to use the mediator they proposed.

My attorney said: Though it’s not unheard of to exchange some proposed settlement offers prior to mediation, more often than not, offers don’t begin to be negotiated until you get into mediation and the mediator has had an opportunity to hear from both parties and gather a better understanding of the underlying issues and key sticking points.

He also said he didn’t have any issue using the mediator they proposed: Ms. Xxxx is an experienced attorney and mediator, with whom I’d venture to say we have just as much of a relationship, as would opposing counsel. However, if you don’t feel comfortable using her, we can always propose an alternative mediator.

Does this make sense? I don’t put much stock in the value of a mediator, but maybe I’m just being cynical.
